He advised the Board to be cautious and said he would <br />not support the proposal. <br />Commissioner Measmer and Mr. Gilkerson responded to a variety of <br />questions from the Board. Mr. Gilkerson reported that the berm on Mulberry <br />Road was constructed and the landfill is in compliance with regulations. <br />Commissioner Measmer advised that the landfill is not in compliance, <br />according to conversations he has had with the Town of Harrisburg. <br />Discussion continued. <br />In response to a question, Richard M. Koch, County Attorney and <br />Harrisburg Town Attorney, advised that he is not aware of any compliance <br />issues. <br />Commissioner Measmer MOVED to table the matter until further <br />discussions can be held. <br />Mr. Grant responded to questions regarding the amount of money the <br />County will save, if this proposal is approved and the lack of air space at <br />the landfill. <br />In response to questions from the Board, Mr. Day advised that he was <br />contacted by Greenway Waste Solutions (GWS) and asked staff to follow up, <br />given the budgetary situation. He further advised that this partnership will <br />save the County a considerable amount of money and that GWS has recycling <br />facilities the County does not have. In addition, the County Planning and <br />Zoning Manager, confirmed last week with the Harrisburg Planning Director <br />that GWS is in compliance. He pointed out that the Memorandum of <br />Understanding (MOU) allows a due diligence period for both parties. <br />Given the budgetary concerns, Vice Chairman Poole expressed support for <br />moving forward. <br />Commissioner Measmer reported the trees on the top of the berm are <br />dead; therefore, the company cannot be in compliance. He advised that to <br />enter into a contractual obligation with this company will put citizens in <br />danger and asked to see other options. <br />Following further discussion, Chairman White stated Commissioner <br />Measmer made a motion earlier to table this matter for further discussion. <br />Commissioner Measmer stated his motion was to table until the Board <br />receives further options. Chairman White called for a second to the motion. <br />The MOTION failed due to lack of a second. <br />Vice Chairman Poole MOVED to place Cabarrus County Construction and <br />Demolition Landfill future operations on the May 16, 2011 Agenda as a New <br />Business item. Commissioner Carruth seconded the motion and requested a <br />report on any violations that may have occurred. <br />After clarification, the MOTION carried, with Chairman White, Vice <br />Chairman Poole and Commissioners Burrage and Carruth voting for and <br />Commissioner Measmer voting against. <br />Mr. Day advised that the Town of Harrisburg will be asked to provide a <br />letter addressing compliance or noncompliance. <br />Mike Downs, Deputy County Manager, advised that the Town Administrator <br />and Planning Director were at the meeting earlier to address the issue, but <br />had to leave. <br />Chairman White requested a letter from NCDENR (North Carolina <br />Department of Environment and Natural Resources) regarding compliance of <br />Greenway Waste Solutions. <br />Transportation - Section 5316 Job Access and Reverse Commute Program Grant <br />(JARC /LINKS) - Project No. 11 -JA -042 <br />With regard to a Section 5316 Job Access and Reverse Commute Program <br />Grant (JARC /LINKS), Randy Bass, Transportation Director, reported the County <br />was awarded a 2 -year extension on the grant and that the process requires the <br />Board to adopt the resolution included in the agenda packet. He further <br />reported the local match of $173,697.00 is the same as last year. Mr. Bass <br />
