<br />and unanimously carried, the Board adopted the following budget amendment:

<br />Purpose: This budget amendment is to do the following: 1) Reclassify budgeted expenses from
<br />Purchased Services to Equipment Rental for the rental of the Positron Host - Remote system for a
<br />full year - $11,385.25 monthly rental. 2) Appropriate funds from FY 2011 Fund Balance for public
<br />safety needs pursuant to Section 9 of Session Law 2010 -158. New legislation now allows for
<br />primary PSAP's to use up to 50% of the Emergency Telephone System Fund Balance at June 30, 2010.
<br />The funds will be used primarily for the purchase of radio and recording equipment.

<br />(F -5) Human Resources — Drug Free Workplace Policy Revision
<br />Cabarrus County recently participated in a Federal Transit
<br />Administration Drug and Alcohol Compliance Program Audit. The County is
<br />required to revise its current Drug Free Workplace Policy. This is a request
<br />to adopt the recommended changes to the Drug Free Workplace Policy: Section
<br />II A and I, Section VII E and F, and Appendix G, L, N, P and Q for compliance
<br />with this federal audit.
<br />UPON MOTION of Commissioner Burrage, seconded by Commissioner Carruth
<br />and unanimously carried, the Board adopted the recommended revisions to the
<br />Drug Free Workplace Policy with authorization for staff to make necessary
<br />administrative adjustments to forms and formatting, grammatical and
<br />administrative adjustments in the published document.
<br />Revisions to Section II A and I, Section VII E and F, and Appendix G,
<br />L, N, P and Q are as follows:
<br />Recommended Changes to the Cabarrus County Drug Free Workplace Policy
<br />Revisions Effective October 17, 2011
<br />II. Definitions
<br />A. Alcohol Test - Any accepted scientific means to determine the
<br />presence of alcohol, including but not limited to laboratory analysis
<br />of breath, urine, saliva, blood, or hair. A DOT regulated alcohol
<br />test may only use urine, saliva, and breath.
<br />I. Drug Test or Screening - Any accepted scientific means to determine
<br />the presence of controlled substances, including but not limited to
<br />laboratory analysis of breath, urine, saliva, blood, or hair. A
<br />DOT regulated drug test may only use urine, saliva, and breath.
<br />VII. Testina Procedures for Applicants and County Emolovees
<br />E. A blood, urine, saliva, breath, or other sample that, after initial
<br />testing, does not reveal the presence of a controlled substance at or
<br />above the threshold values designated by SAMHSA or an alcohol content
<br />level below 0.04% shall be considered to have tested negative, and no
<br />further testing may be done on that sample. For a DOT drug test the
<br />verified presence of the identified drug or its metabolite below the
<br />minimum levels specified in 49CFR Part 40, as amended, and the
<br />specimen is a valid specimen shall be considered to have tested
<br />negative. A DOT regulated alcohol or drug test m only use urine,
<br />saliva, and breath sample.
<br />F. A blood, urine, saliva, breath, or other sample that, after
<br />confirmatory testing, does reveal the presence of a controlled
<br />substance at or above the threshold values designated by SAMHSA or an
<br />alcohol level at or above 0.04% shall be considered to have tested
<br />positive. An employee with a confirmed alcohol test result of between
<br />0.02% and 0.039% will be deemed unfit to perform his or her duties and
<br />sent home. For a DOT drug test the verified presence of the identified
<br />drug or its metabolite at or above the minimum levels specified in
