January 19, 2010 (Regular Meeting) Page 1767 <br />The requested right-of-way and road maintenance abandonment for a <br />portion of Atando Road, Cabarrus County, North Carolina is depicted as <br />follows: <br />(F-2) Commerce - Voluntary Mitigation Payment Adjustment for 2010 <br />Information related to the Voluntary Mitigation Payment (VMP) <br />adjustment required each January by Chapter 15, Adequate Public Facilities, <br />of the Cabarrus County Zoning Ordinance is provided. <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Poole <br />and unanimously carried, the Board adopted the Adequate Public Facilities <br />Voluntary Mitigation Payment percentage amount of 60.572 percent for 2010. <br />(F-3) Finance - Property Easements for the A.T. Allen Replacement Elementary <br />School - $20,000.00 <br />On January 4, 2010, the Cabarrus County Board of Education (BOE) is <br />scheduled to approve the purchase of property easements from the following <br />landowners: James and Emily Love ($10,000.00), Alan C. Maulden ($5,000.00), <br />and Donald S. Maulden ($5,000.00). The Board of Education requests the <br />Cabarrus County Commissioners approve the easements and pay the easements out <br />of the A.T. Allen Replacement Elementary School land budget. <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Poole <br />and unanimously carried, the Board approved the purchase and payment of the <br />property easements between the Cabarrus County Board of Education and <br />landowners: James and Emily Love, Alan C. Maulden, and Donald S. Maulden, <br />subject to approval by the Cabarrus County Board of Education. <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Poole <br />and unanimously carried, the Board authorized the abandonment of road <br />maintenance and right-of-way for a portion of Atando Road and authorized the <br />County Manager to execute any related documentation. <br />
