February 15, 2010 (Regular Meeting) Page 1788 <br />grant, bargain, sell and convey unto the Grantee all of the right, title and <br />interest of Grantor in and to those Right-of-Way and Easement Agreements <br />and/or Deeds and any Right-of-Way Encroachment Agreements [with the N.C. <br />Department of Transportation ("DOT") or otherwise] heretofore conveyed to <br />Grantor and owned by Grantor (in whole or in part) in connection with the <br />sewer utility operation of the Grantor (or its agents, assigns or licensees) <br />now or formerly commonly known as the "Mt. Pleasant Pump Station, Forcemain <br />_and Dutch Buffalo Creek Sewer Interceptor" and the "Back Creek Interceptor <br />Supplement" located in Cabarrus County, North Carolina, including, but not <br />limited to, such right, title and interest in and to the Rights-of-Way and <br />Easements, the Deeds and Right-of-Way Encroachments [with the N.C. Department <br />of Transportation ("DOT")], more particularly described and set forth in <br />Exhibit A, Exhibit B and Exhibit C attached hereto and incorporated herein by <br />reference. <br />The property hereinabove described was acquired by Grantor (as <br />interests may appear) by instruments recorded in the office of the Register <br />of Deeds of Cabarrus County, more particularly identified in Exhibit A, <br />Exhibit B, and/or Exhibit C attached hereto and incorporated herein by <br />reference [and specifically referenced in that column thereof designated <br />"ROW/DEED RECORD" ("DOT" representing an encroachment agreement with or for <br />N.C. DOT for the road identified in "Grantee") and otherwise]. <br />TO HAVE AND TO HOLD the aforesaid Rights-of-Way and Easements, Deeds <br />and Right-of-Way Encroachments and all privileges and appurtenances thereto <br />belonging to the Grantee in fee simple. <br />HOWEVER, THE GRANTOR makes no warranty, express or implied, as to title <br />to the property, whether Right-of-Way and Easement Agreement, Deeds, Right- <br />of-Way Encroachment Agreement or otherwise, hereinabove described. <br />IN WITNESS WHEREOF, the Grantor has duly executed the foregoing as of <br />the day and year first above written. <br />CABARRUS COUNTY <br />By: /s/ H.
