<br />income taxation, except to the extent that the County obtains an opinion of
<br />bond counsel to the effect that noncompliance would not result in interest
<br />with respect to the 2010B Certificates and /or Limited Obligations or the
<br />2010C Certificates and /or Limited Obligations, respectively, being includable
<br />in the gross income of the owners of the 2010B Certificates and /or Limited
<br />Obligations or the 2010C Certificates and /or Limited Obligations,
<br />respectively, for purposes of federal income taxation.
<br />Section 11. This Resolution shall become effective immediately upon
<br />its adoption.
<br />Thereupon, upon motion of Commissioner Carruth, seconded by
<br />Commissioner Vice Chairman Poole, the foregoing resolution entitled
<br />"RESOLUTION APPROVING REFINANCING OF PRIOR INSTALLMENT CONTRACT FINANCINGS IN
<br />AN AGGREGATE PRINCIPAL AMOUNT UP TO $45,000,000 AND THE EXECUTION AND
<br />DELIVERY BY THE CABARRUS COUNTY DEVELOPMENT CORPORATION OF CERTIFICATES OF
<br />PARTICIPATION AND /OR LIMITED OBLIGATION BONDS RELATED THERETO, AUTHORIZING
<br />THE EXECUTION AND DELIVERY OF RELATED DOCUMENTS IN CONNECTION THEREWITH, AND
<br />PROVIDING FOR CERTAIN OTHER RELATED MATTERS" was adopted and passed by the
<br />following vote:

<br />(F -11) General Services - Award of Service Truck Bid to Hilbish Ford for
<br />$414,190.00
<br />A public bid for four (4) service trucks was advertised and four (4)
<br />companies submitted sealed bids. The lowest bid was Hilbish Ford at
<br />$141,190.00. Request approval to proceed with purchasing the vehicles from
<br />Hilbish Ford.

<br />(www.cabarruscounty.us) on July 26, 2010.
<br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Poole
<br />and unanimously carried, the Board approved the bid award and authorized the
<br />County Manager to execute the contract between Cabarrus County and Hilbish
<br />Ford, subject to revision by the County Attorney.
<br />(F -12) Human Resource - Cabarrus County Personnel Ordinance Revision
<br />The ethics bill, H961, was signed by the Governor on August 2, 2010 and
<br />becomes effective October 1, 2010. This law changes N.C.G.S. §153A -98 which
<br />governs personnel records for county employees and impacts the information
<br />regarding county employees that is considered public record. This is a
<br />request to adopt the recommended changes to the Cabarrus County Personnel
<br />Ordinance, Articles VII and X, for compliance with this state law. A copy of
<br />the proposed revisions is included showing the recommended deletions (red,
<br />line through type) and additions (blue, underline type).
