November 15, 2010 (Regular Meeting) <br />Page 196 <br />Dennis Testerman, Senior Resource Conservation Specialist, presented a <br />plaque to Bob Ritchie for his years of service on the Soil and Water <br />Conservation District. He stated Mr. Ritchie served as Chairman for the past <br />year and Vice Chairman for three years before that. He reviewed Mr. <br />Ritchie's accomplishments and stated he has been nominated to be supervisor <br />for the year for the State association. <br />Mr. Ritchie accepted the plaque and expressed appreciation. <br />(C -2) Emergency Mgmt - Recognition of Steven Langer as the Recipient of the <br />2010 Vance Kee Award from the NC Emergency Management Association <br />Bobby Smith, Emergency Management Director, recognized Steven Langer, <br />Fire Marshal, as the recipient of the 2010 Vance Kee Award. He advised Mr. <br />Langer was recognized by his peers at the N.C. Emergency Management <br />Association Awards Banquet on October 26, 2010 and stated the state -wide <br />award is given to a local emergency management staff member who has <br />demonstrated outstanding achievement in promoting their county's emergency <br />management program to county and state agencies. <br />Mr. Langer accepted the award and expressed appreciation. <br />(D) INFORMAL PUBLIC COMMENTS <br />Chairman White opened the meeting for Informal Public Comments at 6:45 <br />p.m. He stated each speaker would be limited to three minutes. <br />Marvin Bost, resident of 3150 Mt. Pleasant Road in Concord, commented <br />on the Cabarrus County Fair. He addressed attendance numbers of other fairs, <br />stated the need for more local events and animals, and said the fair is <br />becoming a glorified carnival. He suggested local businesses be invited to <br />the fair for dinner as a strategy to increase attendance. He reviewed the <br />number of animals he brought to the fair and presented an invoice to the <br />Board for costs he incurred at the 2010 Fair and was not reimbursed for. <br />Price Crutchfield, resident of 592 Love Street in Concord, expressed <br />dissatisfaction with the Concord Police Department, citing his recent arrest <br />for calling the Police Department, "a bunch of child molesters" after he <br />protested a plea- bargain deal a member of the Department received in relation <br />to a felony sex crime committed against a minor. He also expressed <br />dissatisfaction with the District Attorney. <br />With there being no one else to address the Board, Chairman White <br />closed that portion of the meeting. <br />(E) OLD BUSINESS <br />(E -1) Elections - Discuss Selection Process for Building Contractor - Tabled <br />from September <br />Chairman White opened the floor for questions from Board members. Mike <br />Downs, Deputy County Manager, responded to questions regarding the <br />compensation for pre- construction services, etc. He advised the GMP <br />(Guaranteed Maximum Price) will be determined later and come back to the <br />Board for approval. <br />To comply with the General Statues, Richard Koch, County Attorney, <br />advised that any motion to approve the contract amendment should include an <br />exemption to N.C.G.S. 143 - 64.32, since the contract is for the same project <br />using the same contractor. <br />UPON MOTION of Commissioner Mynatt, seconded by Chairman White and <br />carried with Chairman White, Vice Chairman Poole and Commissioners Mynatt and <br />Privette voting for and Commissioner Carruth voting against, the Board <br />approved the amendment to the contract between Cabarrus County and CM Black <br />Construction Company, Inc. for Construction Manager At Risk services and an <br />exemption from Chapter 143 of the N.C.G.S. <br />(E -2) APPAC - Resolution Pertaining to Future of Animal Shelter in Cabarrus <br />County <br />Commissioner Carruth advised the Animal Protection and Preservation <br />Advisory Committee (APPAL) continues to work on the resolution presented at <br />the November work session; however, it will not be finalized until the <br />Board's December meeting. Further, he said the Committee believes that the <br />Cabarrus Humane Society (CHS) is the only rescue organization in the county <br />
