February 16, 2009 (Regular Meeting) Page 1258 <br />changes related to the North Carolina Department of Natural Resources (NCDNR) <br />requirements created a need for additional funds; the project was sent to bid <br />before receiving permit approval from the City of Concord; in December 2008, <br />19 months later, final comments from the City of Concord were received from <br />the City of Concord; the original balance of contingency was $375,000.00; <br />after change orders for rock and contaminated soil, preferred vendors, and <br />curb and guttering changes, the contingency balance is -$168,000.00; <br />transferring funds from one project to another; the need to leave adequate <br />contingency funds to finish the project; available funds for the Furr <br />elementary project; etc. Mr. Shepherd stated his availability to respond to <br />questions from the Board. <br />In response to a question from Commissioner Carruth, Dr. Shepherd <br />reported the City of Concord requested improvements be made by CCS to Union <br />Cemetery Road. <br />Commissioner Poole commented on the following issues: due to the <br />masonry and metal in school buildings, the Nextel signal is inconsistent and <br />the proposed boosters are needed; she has attended games at Hickory Ridge <br />High School and affirmed there are too few seats and many come early and <br />bring lawn chairs in order to watch games; construction plans are subject to <br />review by many organizations and are subject to permitting; the process for <br />school construction and road improvements; this request is for reallocation <br />of approved funds; the Board deserves answers but does not have line item <br />veto; equalization of funds; the expectation of future issues with rock, <br />water and Union Cemetery Road; etc. <br />Commissioner Carruth stated if the Board does not approve the transfer <br />of money, the County will have to provide additional funds. <br />In response to a question from the Board, Sam Masters, Cabarrus County <br />Schools Construction Director, stated Hickory Ridge High School came in over <br />budget initially. He stated several alternates were not awarded when the <br />contract was approved. <br />Jim Greene, Concord Deputy City Manager, stated he wanted to clarify <br />the following information: there is not a plan for Rock Hill Church Road, <br />there is not a CIP, it is not in the TIP, it has not been presented to <br />Council and Council has not approved anything; there have been many meetings <br />with school staff; the transportation plan contains a corridor showing a <br />future extension for Rock Hill Church Road connecting into Union Cemetery <br />Road; there is no direction currently on that extension; the plan for the bus <br />garage was presented by the architect to the City of Concord on March 11, <br />2008; the permit was presented on August 28, 2008; in order to help speed the <br />project along at the request of the school system, Concord did approve in <br />advance the grading permit and the foundation permit before the final permit <br />was approved; a comment regarding the inclusion of curb and guttering along <br />Union Cemetery Road was included in the original comments from the first <br />submission; etc. Mr. Greene responded to questions from the Board regarding <br />the purpose of the curb and guttering. <br />Commissioner Poole MOVED to approve the reallocation as requested by <br />Cabarrus County Schools and adopt the related budget amendment. Commissioner <br />Carruth seconded the motion. <br />Chairman White addressed concerns with the following issues: why the <br />bidding is being done before permitting; why schools are being required to <br />put curb and guttering in the amount of $187,000.00 to a small portion of <br />Union Cemetery Road when there are detention ponds to cover runoff water; <br />transferring money from a project that comes in under budget; preferred <br />vendors; etc. A discussion ensued. The following issues were addressed: <br />why the bus garage is not a metal building; UDO (Unified Development <br />Ordinance) standards related to metal buildings; communication between the <br />two Boards; etc. <br />The MOTION carried with Chairman White, Vice Chairman Mynatt and <br />Commissioner Carruth and Poole voting for and Commissioner Privette voting <br />against. <br />The budget amendment is as follows: <br />Date:2/16/2009 Amount:!$867,261.00'. <br />Dept.
