April 20, 2009 (Regular Meeting) <br />Page 1343 <br />The APFO worksheet filled out by Mr. Robert Kluttz with Cabarrus <br />County Schools indicates that schools impacted by the Castlebrook <br />Manor subdivision project are currently functioning at the <br />following capacities: <br />Note: These percentages are based on the enrollment figures from <br />February 6, 2009. <br />W.R. Odell Elementary School - 101.46°s <br />Harris Road Middle School - 123.00 <br />Northwest Cabarrus High School - 126.90 <br />Including previously approved subdivisions, these schools will be <br />functioning at the following capacity upon completion of the <br />Castlebrook Manor subdivision project: <br />W.R. Odell Elementary School -199.22 °s <br />Harris Road Middle School - 176.29 <br />Northwest Cabarrus High School - 188.15 <br />The Capital Improvements Plan (CIP) includes a new elementary <br />school in 2013 in the northwest area with capacity for 800 <br />students. When this new school opens, 800 students will be <br />transferred from W.R. Odell Elementary School to the new <br />elementary school due to redistricting. <br />A new 1200 seat middle school is included in the plan for 2009 in <br />the northwest/Weddington Road area of the County. When this new <br />school opens, 700 students will be transferred from Harris Road <br />Middle School to the new middle school due to redistricting. <br />Cox Mill High School is scheduled to open August 2009 with <br />capacity for 1450 students. When this new school opens, 1950 <br />students will be transferred from Northwest Cabarrus High School <br />to the new high school due to redistricting. <br />Cabarrus County Schools operating at 110 capacity are considered <br />to be operating at maximum capacity. <br />Ms. Morris stated the current Consent Agreement is expired and the <br />developer needs to negotiate a new Consent Agreement in order to move <br />forward. She stated the applicant is requesting the build-out schedule and <br />the timing of the Adequate Public Facilities Ordinance (APFO) payment be <br />amended. She reported that Mr. Calvin Kiser, representative of the <br />developer, is present to answer any questions. <br />Vice Chairman Mynatt MOVED to approve a Consent Agreement between <br />Cabarrus County and Triune Development, LLC for the Castlebrook Manor <br />subdivision, including the payment of $9,034.00 per lot to advance school <br />adequacy due at permitting for 28 lots (the remaining 92 lots to be paid <br />prior to final platting); including the following build-out schedule: 28 <br />lots in 2009, 15 lots in 2010, 15 lots in 2011 and 12 lots in 2012; and to <br />authorize the County Manager to execute the Agreement on behalf of Cabarrus <br />County, subject to review or revisions by the County Attorney. Commissioner <br />Carruth seconded the motion. <br />Commissioner Privette voiced his intent to vote against the motion, <br />noting school overcrowding. <br />Commissioner Poole voiced her intent to vote against the motion, noting <br />the Board's current policy is to collect APED payments at final platting <br />rather than at permitting. She stated if the Board intends to continue to <br />approve the payment of fees at permitting, then the policy should be amended. <br />Vice Chairman Mynatt stated in these economic times, it is critical not <br />to ask developers to pay APFO fees at platting and allow developers to pay at <br />permitting. <br />The MOTION carried with Chairman White, Vice Chairman Mynatt and <br />Commissioner Carruth voting for and Commissioners Poole and Privette voting <br />against. <br />Commissioner Carruth requested to add a discussion regarding the <br />Board's current policy of APFO payments to the May 9 Agenda Work Session. <br />- New Government Offices Complex - Cabarrus Avenue <br />
