April 20, 2009 (Regular Meeting) <br />Page 1314 <br />address during the November 16, 1993 meeting. Rowan County's act <br />of assigning additional addresses on Denny Rumple Road, however <br />convenient for the county, does not constitute a right of way or <br />easement, nor does it present Cabarrus County with justification <br />to seize Denny Rumple Road for any purpose including 911 System <br />access. <br />There may be no way to measure the devastating effects this <br />County instigated trespass had on Mr. Tucker's health however, I <br />have firsthand experience regarding the impacts these intrusions <br />have on ones quality of life. Mr. Tucker spent his twilight <br />years standing in his driveway, Denny Rumple Road, screaming at <br />people to get off his property. This could not have been <br />pleasant for him or his family. Cabarrus County's confiscation <br />of Denny Rumple Road has stripped me of my Right to Quiet <br />Enjoyment of my property just as it did to Mr. Tucker. <br />The third and last issue is the habitual littering, destruction <br />of property and disruptive behavior I am forced to endure. Your <br />letter states that the Sheriffs department is patrolling the area <br />in an attempt to catch the perpetrator in the act. On April 10, <br />2009 Officer Moreau of the Cabarrus County Sheriffs department <br />responded to a call by me. Officer Moreau explained that he <br />could not do anything about trash on Denny Rumple Road unless it <br />is hazardous waste or a sufficient amount is dumped to create a <br />health threat. He explained that these kids have every right to <br />throw trash on Denny Rumple Road comparing it to a home owner <br />throwing trash in their own driveway. He also noted there is no <br />posted speed limit on Denny Rumple Road, so the erosion of my <br />driveway due to their excessive speed will continue. Property <br />damage such as what happened multiple times to my fence can be <br />addressed if the police can catch them in the act or if I can get <br />a picture of the perpetrator. Since the geographic area and <br />topology of Denny Rumple Road make it impossible for police <br />surveillance my only recourse is to have remote cameras installed <br />at great expense. Officer Moreau also stated that I needed to <br />take legal action against the Rowan County residents that are <br />trespassing. In essence I need a court order to provide Cabarrus <br />County Police authority to enforce my right to prohibit trespass. <br />That is quite different than what you stated in the letter and <br />doubtless a more honest portrayal of the County's attitude, thus <br />it renders your assertion that "the County is doing all it can to <br />assist me" mere rhetoric the County Commission determined to <br />substitute for protecting me and my property. <br />The statement you make in your letter quote: "The County is <br />doing all it can to assist you in this, consistent with its <br />obligations to all of its other residents" is confused since I am <br />the only resident involved that pays taxes in Cabarrus County. <br />The residents that live in Rowan County using Denny Rumple Road <br />know they have no deeded easement or right of way on my property, <br />they are exploiting the County's pirating of Denny Rumple Road <br />for 911 System access. Eberhart lived without water or electric <br />for two (2) years and walked to his trailer because Denny Rumple <br />Road was overgrown. Mr. Eberhart boasted he cut down the trees <br />that cleared the road. Mr. Miller bought his property from a <br />woman whose bank foreclosed because there was no right of way. <br />Mr. Miller had to pay cash for the same reason. Additionally <br />these properties are not land locked. There is access for these <br />people via Rowan County from both Plyler Road and Wright Road; in <br />fact Plyler Road is one of the parcels from the W.L. Rumple <br />estate. These residents of Rowan County know they are <br />trespassing and Mr. Tucker positioned in the middle of Denny <br />Rumple shouting "get off my road" surely left no doubt. After <br />repeated attempts to work with the County to resolve this issue I <br />understand why the elderly and frail Mr. Tucker was reduced to <br />shrieking in the middle of the road rather than work within the <br />legal process. I cannot comprehend Cabarrus County abetting <br />trespass nor can I understand how these people obtained occupancy <br />permits without verifying deeded access rights. How did the <br />County assign 911 System access without verifying deeded access. <br />I am not sure the County considered the consequences of assigning <br />these people addresses on a private road without legal access <br />then compounding the problem by assigning these addresses for 911 <br />System access, I want to take this opportunity to make plain the <br />
