April 20, 2009 (Regular Meeting) <br />Page 1315 <br />ongoing damage to my property and health; the consequences of the <br />County decision. <br />Lack of sleep and stress are causing me frequent and sever <br />migraine headaches which will eventually progress into a seizure. <br />Neurologist Dr. Paul B. Rizzoli MD, Faulkner Hospital, Boston <br />Massachusetts treated me for a seizure and required me to <br />surrender my driver's license for a year. The inability to drive <br />will make working and socializing nearly impossible, rob me of <br />the ability to earn a living, and make it impossible to live an <br />independent life. In addition to the damage to my health and <br />quality of life, Denny Rumple Road has been destroyed and will <br />need to be resurfaced at a cost of approximately $19,080.00. The <br />legal fees I will incur to undo the access rights granted by the <br />county have already started to add up. I will be forced to take <br />legal action against the Rowan County residents presently using <br />Denny Rumple as well as all residents assigned an address and <br />granted 911 System access. <br />Cabarrus County, the individuals on this board, along with <br />Sheriff Riley and Mr. Bobby Smith are responsible and need to be <br />held accountable for the destruction of Denny Rumple Road, the <br />legal fees to undo 'convenient assignment of 911 System access, <br />the considerable pain and stress put on me as well the threat to <br />my quality of life. Of course when Z am no longer able to earn a <br />living there will be additional monetary damages. This board in <br />partnership with Sheriff Riley and Mr. Bobby Smith made the <br />decision to take my private property for County use and in doing <br />so stripped me the legal structure necessary for a quality life. <br />Dealing on a daily basis with disruptive neighbors adds stress to <br />my life. However knowing that law enforcement is unavailable and <br />that the county is unwilling to correct a mess created for <br />clerical convenience is the most devastating element of the <br />assault on my peace and quiet. <br />The purpose of this letter to ensure the County, this Board, as <br />well as Mr. Smith and Sheriff Riley understand fully the <br />consequences of their decision and that I hold them accountable <br />and responsible for real damages of $14,090 for the resurfacing <br />of Denny Rumple Road, $2000.00 in legal fees to date, as well as <br />all additional legal fees. <br />Sincerely, <br />Lynda DeLellis <br />With there being no one else to address the Board, Chairman White <br />closed that portion of the meeting. <br />(E) OLD HUSINE53 <br />None. <br />(F) CONSENT AGENDA <br />(F-1) Aging - Naming o£ Concord Senior Center Park, Trail, and Shelter <br />A public hearing was held on February 16, 2009 to receive comments on <br />names for the park and facilities at the Concord Senior Center. Following <br />the public hearing, the Department of Aging Advisory Board unanimously voted <br />to submit the following names to the Board of Commissioners for approval: <br />1. Concord Senior Center Park to be named - Martha T. Miller Park <br />2. Concord Senior Center Trail to be named - James A. Graeber Trail <br />3. Concord Senior Center Shelter to be named - Cabarrus County Council <br />on Aging Shelter <br />UPON MOTION of Commissioner Carrut h, seconded by Commissioner Privette <br />and unanimously carried, the Board approved the aforementioned names for the <br />Cabarrus County Senior Center - Concord park and facilities, as submitted by <br />the Department of Aging Advisory Board. <br />(F-2) HOC - Resolution of Support, SB 967 - Creation of the Yadkin River <br />Trust, Etc. <br />
