May 18, 2009 (Regular Meeting) <br />Page 1385 <br />Commissioner Carruth announced he will arrive at the May 19t" Budget <br />Meeting at approximately 9:95 p.m. <br />Lee <br />Chairman White announced Cabarrus County has settled the Case Jimmy Lee <br />Barley Sr. v Troy L. Fields and Cabarrus County, 08 CVS 2265 (Cabarrus <br />County Superior Court). This case involved a claim for damages against Mr. <br />Fields, a former County employee and against the County for personal injuries <br />sustained by Mr. Barley as a result of a vehicular collision with a County <br />vehicle driven by Mr. Fields which rear-ended Mr. Barley's vehicle. The <br />County did not dispute liability for this claim, but did dispute the value of <br />the claim. Mr. Bartley had medical bills exceeding $104,000.00 and made a <br />settlement demand of $800,000.00. On advice of counsel, the County settled <br />this matter for payment of $230,000.00 to plaintiff. Approval of the terms <br />of the settlement was made by the Commissioners in closed session as <br />permitted by the Open Meetings Law. The case has been dismissed and the <br />matter is concluded. Announcement of this settlement is made pursuant to the <br />Open Meetings Law (N.C.G.S. 143-318.11) <br />Chairman White announced Budget Workshop Meetings will be held May 19, <br />20, and 21 in the Multipurpose Room in the Governmental Center at 3:30 p.m. <br />(K) WATER AND SEWER DISTRICT OF CABARRUS COUNTY <br />None. <br />(L) CLOSED SESSION <br />None. <br />(M) RECESS <br />UPON MOTION of Commissioner Poole, seconded by Vice Chairman Mynatt and <br />unanimously carried, the meeting recessed at 6:07 p.m. until 3:30 p.m. on <br />Tuesday, May 19, 2009 in the Multipurpose Room at the Governmental Center. <br />Clerl to the Bo <br />
