May 28, 2009 (Recessed Meeting) <br />Page 1423 <br />The Board took a short break at 5:53 p.m. The meeting reconvened at <br />6:01 p.m. <br />(C-17) Rezoning Case 2009-15 (R) - Scott C. Robertson - Zonin Atlas <br />Amendment to Rezone Property from CR to LDR - Continued <br />UPON MOTION of Commissioner Privette, seconded by Chairman White with <br />Chairman White, Vice Chairman Mynatt, and Commissioners Poole and Privette <br />voting for and Commissioner Carruth voting against, the Board approved the <br />rezoning request for Parcel Identification Numbers 5549-88-8214, 5599-88- <br />5136, 5549-87-7714 and 5599-88-2359, Case 2009-15 (R) - Scott Robertson. <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth, <br />and unanimously carried, the Board adopted the following Consistency <br />Statement: the proposed rezoning is consistent with densities pertained in <br />the CALUP, and it is reasonable and in the public interest because some of <br />the surrounding property is already zoned LDR and the proposed zoning is <br />consistent with surrounding uses. <br />(D) OTHER BUSINE93 <br />SD-1) Sheriff's Dept. - Senate Hill 521 / House Bill 546 - A Bill to be <br />Entitled "An Act Expanding Permitted Uses of 911 Funds in Lincoln and Wayne <br />Counties" <br />Chairman White presented information related to Senate Bill 521 / House <br />Bill 546 - A Bi11 to be Entitled "An Act Expanding Permitted Uses of 911 <br />Funds in Lincoln and Wayne Counties". He stated it is his understanding the <br />bill passed in the Senate today and the Board needs to decide if they would <br />like to be a part of House Bill 546. He explained this would allow the <br />County to use 911 funds for items other than equipment. <br />UPON MOTION of Commissioner Privette, seconded by Vice Chairman Mynatt, <br />and unanimously carried, the Board authorized the County Manager or his <br />designee to request Cabarrus County's local legislative delegation to include <br />Cabarrus County in Senate Bill 521 / House Bill 546. <br />(D-2) Closed Session - NCGS 143-318.11 (a)(6) <br />A closed session is needed to consider the qualifications, competence, <br />performance, character, fitness, conditions of appointment, or conditions of <br />initial employment of an individual public officer or employee or prospective <br />public officer or employee; or to hear or investigate a complaint, charge, or <br />grievance by or against an individual public officer or employee. <br />UPON MOTION of Vice Chairman Mynatt, seconded by Commissioner Privette, <br />and unanimously carried, the Board moved to go into Closed Session pursuant <br />to N.C.G.S. 143-318-11(a)(6). <br />UPON MOTION of Commissioner Carruth, seconded by Chairman White and <br />unanimously carried, the Board moved to come out of Closed Session at 6:09 <br />p.m. <br />Approval of Hiring Salary for the Department of Social Service Director <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board approved the hiring salary for Department <br />of Social Services Director above the job rate for the grade. <br />(E) ADJOURN <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Mynatt <br />and unanimously carried, the meeting adjourned at 6:09 p.m. <br />'1 ~ <br />Cle to he B rd <br />
