June 1, 2009 (Work Session) Page 1430 <br />Terry Crawford, Tourism Authority Chair, stated that Mr. John Mills, <br />Director of Finance and Administration for the Tourism Authority (TA), would <br />be presenting the TA's FY 2010 Budget. He added that included in the budget <br />presentation is a request for the County to reduce its administrative fee <br />from 5 percent to 1.5 percent. <br />John Mills, Director of Finance and Administration, presented <br />highlights of the Tourism Authority FY 2010 Budget totaling $3,789,069.00 as <br />follows: the Tourism Authority Board of Directors adopted the FY 2010 Budget <br />at its May 7, 2009 meeting; efficiencies gained in the salaries and <br />administration areas of the budget were transferred to marketing; this year <br />is the first year the TA is completing its SO1C-6 non-profit status; <br />previously, all financial, human resources, and administrative tasks were <br />handled by the County, but now reside with the TA; the County currently <br />maintains the task of collecting and remitting hotel occupancy tax; the TA <br />requests the reduction from 5 percent to 1.5 percent of administrative fee <br />costs paid to the County in turn for the sports facilities development <br />funding, which will begin next year. <br />Commissioner Privette requested the TA present detailed salary <br />information at the June 15, 2009 Regular meeting. <br />In response to a question from Vice Chairman Mynatt, Mr. Crawford <br />explained that the County lacks the proper facilities for major sporting <br />events for such sports as baseball and softball. He stated there is an <br />opportunity to build facilities to attract that type of business to the <br />County, which would, in turn, increase occupancy in Cabarrus County hotels. <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth, <br />and unanimously carried, the Board voted to place the Presentation and <br />Adoption of FY 2010 Tourism Authority Budget - $3,784,069.00 on the June 15, <br />2009 Agenda as a New Business item. <br />- Permits for Sound Amplification - <br />Captain Phillip Patterson, Cabarrus County Sheriff's Department, <br />presented a request to amend Chapter 30, Section 30-28 of the Cabarrus County <br />Code of Ordinances that allows the Sheriff to issue sound amplification <br />permits. He stated the amendment would obligate the applicant to notify <br />surrounding residents at least 72 hours prior to an event if the applicant <br />has a need for some type of sound magnification. <br />Chairman White asked how the Sheriff's Department plans to enforce the <br />ordinance and, in particular, how the volume of the sound will be measured. <br />Capt. Patterson stated that the volume of the noise will be measured at <br />the discretion of the responding officer. He reported the sound permit will <br />not give an applicant permission to play music loud enough to disturb <br />neighbors. He also explained that this permit would not be applicable inside <br />any municipality. <br />Further discussion ensued. Capt. Patterson continued by stating that <br />neighbors will be notified of the date, time, and duration of an event which <br />may produce loud noise. <br />In response to further questioning from the Board, Capt. Patterson <br />explained that if the sound of music leaves the confines of a residence and <br />disturbs a neighbor, one could be in violation of the noise ordinance. He <br />stated that a decibel level was not specified in the ordinance because <br />enforcement of such a level would be costly and require special equipment. <br />UPON MOTION of Vice Chairman Mynatt, seconded by Commissioner Poole, <br />and unanimously carried, the Board voted to place the Permits for Sound <br />Amplification - Amend Chapter 30, Section 30-28 of the Cabarrus County Code <br />of Ordinances on the June 15, 2009 Agenda as a New Business item. By the <br />same vote, the Board scheduled a public hearing for 6:30 p.m. <br />Finance - Adoption of FY 2010 Cabarrus County Budget and Public Hearing - <br />6:30 p.m. <br />UPON MOTION of Commissioner Privette, seconded by Vice Chairman Mynatt, <br />and unanimously carried, the Board voted to place the Adoption of the FY 2010 <br />Cabarrus County Budget on the June 15, 2009 Agenda as a New Business item. <br />By the same vote, the Board scheduled a public hearing for 6:30 p.m. <br />
