June 15, 2009 (Regular Meeting) <br />Page 1437 <br />Award. He recognized the Cabarrus County Waste Reduction Department and the <br />citizens of Cabarrus County for their recycling efforts and participation in <br />the proper disposal of household hazardous waste and presented the award to <br />Pete Pasterz, Cabarrus County Waste Reduction and Recycling Coordinator. <br />D) INFORMAL PUBLIC COMMENTS <br />None. <br />(E) OLD BUSINESS <br />None. <br />(F) CONSENT AGENDA <br />Commissioner Poole requested the following item be removed from the <br />Consent Agenda for discussion: Item F-1 (County Manager - Architectural <br />Contract - YCH Architects - New Cabarrus County Government Office Building <br />and Site Design). <br />UPON MOTION of Commissioner Carruth, seconded by Commissioner Poole, <br />and unanimously carried, the Board approved the Consent Agenda as amended. <br />(F-1) County Manager - Architectural Contract - YCH Archi teota - New <br />Cabarrus County Government Office Building and Site Design <br />Note: This item was removed from the Consent Agenda and placed on New <br />Business for discussion. See Item G-11. <br />(F-2) Emeraenev Management - Odell Volunteer Fire and Rescue. Inc. Financing <br />for New Station <br />Ode11 Volunteer Fire and Rescue, Inc. will finance an amount of up to <br />$2,000,000.00 with BB&T for the construction of a new fire station. The <br />United States Revenue Code requires that for such financing to be carried out <br />on a tax-exempt basis, the Cabarrus County Board of Commissioners must <br />approve the financing by adopting the following resolution. Ode 11 Volunteer <br />Fire Department and Rescue, Inc. held a public hearing on the financing, as <br />required by the Code on April 21, 2009. <br />UPON MOTION of Commissioner Carruth, seconded by Commissioner Poole and <br />unanimously carried, the Board adopted the following resolution: <br />Resolution No. 2009-13 <br />Cabarrus County Board Resolution <br />Resolution Approving the Financing by Odell Volunteer Fire & Rescue, <br />Incorporated <br />of up to $2,000,000 for the Fire Station Project <br />WHEREAS; <br />Odell Volunteer Fire & Rescue, Incorporated has determined to finance an <br />amount of up to $2,000,000 for the Fire Station. The United States Internal <br />Revenue Code requires that for such financing to be carried out on a tax- <br />exempt basis, this Board must first approve the financing. The VFD has held <br />a public hearing on the financing after published notice as required by the <br />Code. The VFD has reported the proceedings of the hearing to this Board. <br />BE IT THEREFORE RESOLVED by the Board of Commissioners of Cabarrus County, <br />North Carolina, as follows: <br />1. The County approves the VFD's entering into the financing, as required <br />under the Code for the financing to be carried out on a tax-exempt basis. <br />The VFD's conduct of the required public hearing is approved. <br /> <br />I hereby certify that the foregoing resolution was duly adopted at a meeting <br />of the Cabarrus County Board of Commissioners duly called and held on June <br />15, 2009, and that a quorum was present and acting throughout such meeting. <br />Such resolution remains in full effect as of today. <br />Dated this 15 day of June, 2009. <br />
