July 20, 2009 (Regular Meeting) <br />November 10, 2008 <br />Cabarrus <br />County Name <br />Page 1492 <br />(F-13) Tax Administration - Approval of Motor Vehicle Receivable Write-off <br />for March 2005 - February 2006 <br />Per G.S. X150-373(h) the Cabarrus County Board of Commissioners may <br />relieve the Tax Collector of the charge of taxes on motor vehicles that are <br />one or more years past due when it appears that the taxes are uncollectable. <br />Historically, the Board of Commissioners have relieved the Tax Collector of <br />the charge of these taxes when they become three (3) years past due. The Tax <br />Collector's Office has exhausted all means of collections on vehicle taxes <br />due from March 2005 through February 2006. The amount to be relieved is <br />$276,897.49 as of July 1, 2009. <br />2005 DMV OUTSTANDING <br />YEAR PRINCIPAL DISCOUNT MISC FEES ADVERTISING INTEREST BALANCE DUE <br />2005 179,519.39 0.00 35,157.92 0.00 62,220.13 276,897.49 <br />UPON MOTION of Commissioner Carrut h, seconded by Commissioner Privette <br />and unanimously carried, the Board granted relief to the Tax Collector of the <br />charge of collecting taxes on classified motor vehicles for renewal months <br />March 2005 through February 2006. <br />(F-14) Tax Administration - Collector's Annual Settlement and Order <br />Authorizing Collection of 2009 Taxes <br />The Tax Collector is required by NC General Statute X105-373 to give an <br />annual settlement on current and delinquent taxes to the governing body for <br />review and approval. There are two settlement reports for fiscal year 2008- <br />2009. One report is for real and personal delinquent and one is for motor <br />vehicle delinquent (taxes that remain unpaid for the preceding fiscal year). <br />Also, there will be a settlement report which shows all taxes charged for <br />collection for fiscal year 2008-2009. This report includes real and <br />personal. Note: The settlement report was not available at the time of <br />agenda distribution and will be provided at the work session. <br />UPON MOTION of Commissioner Carrut h, seconded by Commissioner Privette <br />and unanimously carried, the Board accepted the Tax Collector's settlement as <br />reported and accepted and approved the following Order in accordance with <br />G.S.~105-321: <br />ORDER OF THE BOARD OF COUNTY COMMISSIONERS IN <br />ACCORDANCE WITH G.S. X105-321 <br />To: J. Brent Weisner <br />Tax Administrator, Cabarrus County <br />You are hereby authorized, empowered, and commanded to collect the 2009-2010 <br />taxes set forth in the tax records filed in the office of the Cabarrus County <br />Assessor, and in the tax receipts herewith delivered to you, in the amounts <br />and from the taxpayers likewise set forth. Such taxes are hereby declared to <br />be a first lien upon all real property of the respective taxpayers in the <br />County of Cabarrus. <br />This Order shall be a full and sufficient authority to direct, require and <br />enable you to levy on and sell any real or personal property of such <br />taxpayers, for and on account thereof, in accordance with the law. <br />Witness my hand and official seal, this 20th day of July 2009. <br />/s/ H.
