August 17, 2009 (Regular Meeting) Page 1527 <br />The Board of Commissioners for the County of Cabarrus met in regular <br />session in the Commissioners' Meeting Room at the Cabarrus County <br />Governmental Center in Concord, North Carolina on Monday, August 17, 2009, at <br />6:30 p.m. <br />Present - Chairman: H. Jay White, Sr. <br />Commissioners: Robert W. Carruth <br />Elizabeth Poole <br />Coy C. Privette <br />Absent - Vice Chairman: Grace Mynatt <br />Also present were John D. Day, County Manager; Richard M. Koch, County <br />Attorney; Mike Downs, Deputy County Manager; Pam Dubois, Deputy County <br />Manager; and Kay Honeycutt, Clerk to the Board. <br />Chairman White called the meeting to order at 6:32 p.m. <br />Girl Scout Troop 255 of Mount Olivet Methodist Church and Girl Scout <br />Troop 232 from Harrisburg United Methodist Church conducted the Elag <br />Ceremony. Scouts participating in the ceremony were: Gabriella Agnello, <br />Madison Castles and Amanda Habrack from Troop 255; and Allyson Johnson, Maura <br />Custer and Ellie Lowry from Troop 232. <br />Associate Pastor Steve Davis from Parkwood Baptist Church in Concord <br />delivered the invocation. <br />(A) APPROVAL OR CORRECTION OF MINUTES <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Poole <br />and unanimously carried, the Board approved the minutes of July 6, 2009 <br />(Agenda Work Session), July 20, 2009 (Regular Meeting), and July 27, 2009 <br />(Special Joint Meeting with Cabarrus County Schools). <br />(B) APPROVAL OF THE AGENDA <br />Chairman White reviewed the following changes to the agenda: <br />At the request of the applicants/counsel, the following items were <br />tabled until September 21, 2009: Old Business Item E-1 (Commerce - Appeal of <br />Request for Extension of Rocky Glen Preliminary Plat Approval [Randall T. <br />Scribner] - [Tabled from July]); Old Business Item E-2 (Commerce - Appeal of <br />Request for Vested Rights [Randall T. Scribner] and Public Hearing - 6:30 <br />p.m. - [Tabled from July)); and New Business Item G-3 (Commerce - Consent <br />Agreement for The Mills at Rocky River Subdivision Project). <br />Addition: Closed Session Item L-1 (Closed Session - To Prevent <br />Disclosure of Privileged or Confidential Information; To Discuss Threatened <br />or Pending Litigation (APFO/SMI); and To Discuss Matters Relating to the <br />Location or Expansion of Industries Pursuant to N.C.G.S. <br />143.318.11(a)(1)(3)(9). <br />UPON MOTION of Commissioner Poole, seconded by Commissioner Privette <br />and unanimously carried, the Board approved the Agenda as amended. <br />(C) RECOGNITIONS AND PRESENTATIONS <br />None. <br />(D) INFORMAL PUBLIC COLM~NTS <br />Chairman White opened the meeting for Informal Public Comments at 6:38 <br />p.m. He stated each speaker would be limited to three minutes. <br />Price Crutchfield, who resides at 592 Love Street, Concord, expressed <br />dissatisfaction with an officer of the Concord Police Department, noting that <br />the officer lied under oath. <br />With there being no one else to address the Board, Chairman White <br />closed that portion of the meeting. <br />(E) OLD BUSINESS <br />- Appeal of Request for Extension of Rocky Glen <br />
