October 5, 2009 (Work Session) Page 1639 <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Poole <br />and unanimously carried, the Board indefinitely tabled the following item: <br />TEXT2009-00008 - Proposed Text Amendment to Amend Chapter 5 and Appendix B of <br />the Cabarrus County Zoning Ordinance. <br />Additional Agenda Items <br />UPON MOTION o£ Commissioner Carruth, seconded by Commissioner Poole and <br />unanimously carried, the Board approved the following list of additional <br />items for the October 19, 2009 Agenda: <br />Recognitions and Presentations: <br />• BOC - Recognition of Fire Chief Edwin C. Phillips on His Retirement <br />from the A11en Volunteer Fire Department <br />• Human Resources - Recognition of Deputy David Blackwelder on His <br />Retirement from Cabarrus County <br />Consent Agenda: <br />• Sheriff's Department - Award Service Weapon to Officer David <br />Blackwelder upon His Retirement on September 30, 2009 from the <br />Sherif £'s Of £ice Pursuant to N.C. General Statute 20-187.2 <br />• Tax Administration - Refund and Release Report - September 2009 <br />Appointments to Board and Committees: <br />• Appointments - Nursing Home Community Advisory Committee <br />Reports: <br />• Commerce - Harrisburg Area Land Use Plan Update - Progress Summary <br />Reports <br />• Request for Applications to County Boards/Committees <br />Finance - Property Easements for the A. T. Allen Replacement Elementarv <br />School - $68,624.00 <br />Len Witke, Director of Construction for Cabarrus County Schools (CCS), <br />reported CCS is working with 17 individual landowners to develop the easement <br />agreements, seven (7) of which are presented to the Board for approval. He <br />also informed the Board CCS has an agreement on six (6) additional easements, <br />but are waiting for W-9 forms to be completed. The last four (4) easements <br />have been negotiated but CCS is waiting for either changes in the agreement <br />language or surveys to support the documents. He also noted 33 percent of <br />the funds allocated for the agreements have been spent down. Lastly, he <br />stated CCS anticipates approximately $75,000.00 to $100,000.00 will be <br />returned to the County when all 17 agreements are finalized. <br />In response to questions from the Board whether the 70 to 75 percent of <br />funding will be spent on all 17 easements and the remaining portion (25 to 30 <br />percent) is anticipated to be returned to the County, Mr. Witke responded in <br />the affirmative. <br />UPON MOTION of Commissioner Carruth, seconded by Commissioner Poole and <br />unanimously carried, the Board voted to place Property Easements for the A. <br />T. Allen Replacement Elementary School on the October 19, 2009 Agenda as a <br />Consent item. <br />Commerce - Transfer o£ Conservation Easement - Concord Airport <br />Jonathan Marshall, Commerce Director, presented the Transfer of <br />Conservation Easement - Concord Airport and discussed issues relating to <br />Concord Mills' mitigation project noting engineers had approved the project <br />for land owned by the City of Concord, but did not want Concord to hold an <br />easement on their own property. As such, the Board of Commissioners agreed <br />to hold the easement. He further noted the County's Soil and Water District <br />has been designated as the agency in this county to hold conservation <br />easements so he proposed the transference o£ the conservation easement to the <br />Cabarrus County Soil and Water Conservation District. <br />Mr. Marshall stated he and Dennis Testerman surveyed the property <br />located behind Roush Racing and attested to its high quality condition and <br />acknowledged the property would be an asset to the conservation easements <br />being held. He noted the County Attorney approved the transference of the <br />easement. <br />In response to the Board's questioning on the functionality o£ the <br />land, Mr. Marshall elaborated on the difficulty of adding a greenway in that <br />
