October 19, 2009 (Regular Meeting) Page 1650 <br />UPON MOTION of Commissioner Privette, seconded by Vice Chairman Mynatt <br />and unanimously carried, the Board adopted the aforementioned proclamation. <br />(D) INFORMAL PUBLIC COML~NTS <br />None. <br />(E) OLD BUSINESS <br />None. <br />(F) CONSENT AGENDA <br />(F-1) Commerce - Transfer of Conservation Easement - Concord Airport <br />The Board of Commissioners accepted a conservation easement on Concord <br />Airport property on March 15, 1999. At that time, it was contemplated that <br />the County would, in the future, transfer that easement to an organization <br />charged with holding and monitoring conservation properties. The Cabarrus <br />County Soil and Water Conservation District is a designated agency for <br />holding these easements and the County proposes that this conservation <br />easement be transferred to the District. <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board approved the transfer of the conservation <br />easement to the Cabarrus County Soil and Water Conservation District with <br />authorization for the County Attorney to complete the necessary documents and <br />the County Manager to execute them. <br />- Dissolution of the Fire Protection District <br />The Fire Protection District Commission is a board authorized by <br />N.C.G.S. 69-25.9 to administer the fire district tax in the event it is not <br />administered by the Board of County Commissioners. Since the Cabarrus County <br />Board of Commissioners administers the fire district tax for Cabarrus County, <br />the appointment of a Fire Protection District Commission is not necessary. <br />It is requested that this board be dissolved. <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board approved the request to dissolve the Fire <br />Protection District Commission for Cabarrus County. <br />- Property Easements i <br />On September 19, 2009, the Cabarrus County Board of Education (BOE) <br />approved the purchase of property easements from the following landowners: <br />Norris Barringer ($5,786.90), Chad Barringer ($25,000.00), Gene Cline <br />($2,500.00), John Mills ($5,000.00), Craig Carter ($9,153.60), Bryan Mills <br />($6,230.90), and Michael Greene ($19,953.60). The Board of Education <br />requests the Cabarrus County Commissioners approve the easements and pay for <br />the easements out of the A. T. Allen Replacement Elementary School Land <br />budget. <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board approved the purchase and payment of the <br />property easements between the Cabarrus County Board of Education and <br />landowners: Norris Barringer, Chad Barringer, Gene Cline, John Mills, Craig <br />Carter, Bryan Mills and Michael Greene as set forth above. <br />(F-4) Sheriff's Department - Award Service Weapon to Officer David <br />Blackwelder upon His Retirement on September 30, 2009 from the Sheriff's <br />Office Pursuant to N.C. General Statute 20-187.2 <br />N.C. General Statute 20-187.2 states the service firearm of a retiring <br />officer shall be awarded for the price of $1.00. Officer Blackwelder retired <br />from the Sheriff's office on September 30, 2009. <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board awarded the service weapon to Officer <br />David Rawlins Blackwelder upon his retirement for the price of $1.00 in <br />accordance with N.C.G.S. 20-187.2. <br />(F-5) Tax Administration - Refund and Release Report - September 2009 <br />
