November 16, 2009 (Regular Meeting) Page 1700 <br />advised there is no obligation on the part of the County until the Board <br />approves the agreement. <br />Chairman White opened the public hearing at 7:21 p.m. The Public <br />Hearing Notice was published on November 4, 2009 in THE INDEPENDENT TRIBUNE. <br />The Public Hearing Notice was also posted on the County's website <br />(www.cabarruscounty.us) on November 4, 2009 in accordance with Article 2, <br />Administration, Section 2.1 (Use of Electronic Means to Provide Public <br />Notices) of the Cabarrus county Code of Ordinances. <br />There was no one present to address the Board; therefore, Chairman <br />White closed the public hearing. <br />No further action was required of the Board. <br />(G-6) Parka Department - Name Proposal for the New Park in Southeast <br />Cabarrus County <br />Mike Downs, Deputy County Manager, reported on the process the County <br />undertook in search of a suitable park site in southeastern Cabarrus County. <br />He reported, after surveying many sites, the County approached Rob and Donna <br />Wallace about their 190-acre tract located south of Midland. He spoke <br />briefly about the negotiation efforts and Mr. and Mrs. Wallace's willingness <br />to sell the property. He briefly discussed the favorable purchase terms and <br />advised the County was able to secure a larger piece of property than what <br />was originally sought. He stated, on behalf of the Parks staff and Parks <br />Commission, it is recommended the proposed park is named "Rob Wallace Park." <br />Chairman White announced he received a fax this morning from Mr. and <br />Mrs. Wallace. He read the following faxed correspondence: <br />T0: Jay White and the Cabarrus County Board of <br />Commissioners <br />FROM: Rob and Donna Wallace <br />DATE: 11/16/09 <br />We are both honored and humbled by the action the Board <br />has taken on the naming of the Park in southern Cabarrus <br />County. <br />We are pleased and thankful to have been blessed to the <br />point where we could have a hand in this facility which <br />should contribute to an enhanced quality of life for <br />Cabarrus County citizens for years to come; however, we <br />want to point out that without your forward thinking as <br />a Board, and without the dedication and professionalism <br />of your staff people, this project would not have been <br />possible. <br />John Day, Mike Downs, Pam Dubois and Londa Strong all <br />deserve recognition for the constructive way in which <br />this project has been approached. <br />We thank you for the opportunity of participating in <br />this exciting project. <br />Rob and Donna Wallace <br />Commissioner Privette moved to name the new park in southeast Cabarrus <br />County the "Rob Wallace Park." Commissioner Poole seconded the motion. <br />The MOTION unanimously carried after the Board expressed appreciation <br />to Rob and Donna Wallace and recognized certain members of the Parks <br />Commission that were in attendance. <br />_(G-7) Commerce - Consent Agreement for the West Oake Subdivision Pro'eot <br />Chairman White advised the Consent Agreement for the West Oaks <br />Subdivision Project needs to be tabled. Mr. Richard M. Koch, County <br />Attorney, advised County staff received a request this afternoon from Richard <br />Flowe, representative of the owners of the project. Mr. Flowe raised issues <br />regarding a proposed amendment to the Consent Agreement which relates to APFO <br />(Adequate Public Facilities Ordinance) litigation the County is currently <br />
