December 7, 2009 (Work Session) <br />Page 1707 <br />stream restoration project; the project will enhance and improve the existing <br />trail; the County removed gravel and an inappropriately constructed bridge; <br />potentially that section of the trail can be redeveloped and restore <br />connection between two nearby schools; and the County is currently looking to <br />extend a segment of the trail on Harris Road. <br />A discussion ensued relating to the use of the trail for outdoor <br />classroom learning and experience. Mr. Marshall provided information <br />regarding a State program that desires to partner with the two schools and <br />incorporate the stream restoration project into the schools' curriculum. He <br />advised the improved greenway, as planned, will help add the educational <br />component. <br />UPON MOTION of Vice Chairman Mynatt, seconded by Commissioner Poole and <br />unanimously carried, the Board voted to place the Proposed Rocky River <br />Greenway at Harris Road Middle School on the December 21, 2009 Agenda as a <br />Consent item. <br />Commerce - Proposed Text Amendment TEXT2009-00012-Chapter 8 - Conditional <br />Uses and Public Hearing - 6:30 P.M. <br />Susie Morris, Planning and Zoning Manager, presented a proposed text <br />amendment to Chapter 8, Conditional Uses of the Cabarrus County Zoning <br />Ordinance; to change the current setback requirements from 250 feet to 150 <br />feet to provide consistency with other agricultural uses in the Ordinance. <br />She requested the item be added to New Business because a public hearing is <br />required. <br />UPON MOTION of Commissioner Carruth, seconded by Commissioner Poole <br />and unanimously carried, the Board voted to place Proposed Text Amendment <br />TEXT2009-00012-Chapter 8 - Conditional Uses on the December 21, 2009 Agenda <br />as a New Business item. By the same vote, the Board scheduled a public <br />hearing for 6:30 p.m. <br />Commerce - Reservation of Capacity Certificate for the Villas at Logan <br />Gardens <br />Susie Morris, Planning and Zoning Manager, presented a request for a <br />Reservation of Capacity Certificate for the Villas at Logan Gardens. She <br />announced Carrie Scogin, development consultant, and Steve Osborne with the <br />City of Concord are present. She provided the following information: this <br />is a joint project between Douglas Development and the City of Concord; the <br />proposed project is for 44 multi-family residential units located near Booker <br />Drive, SW, in the City of Concord; the proposed project will be age- <br />restricted; and the Board has the option of granting an exemption or applying <br />the APFO (Adequate Public Facilities Ordinance) to the project. She advised <br />Richard Koch, County Attorney, has been working with the City of Concord's <br />attorney on the project. <br />The Reservation of Capacity schedule for the Villas at Logan Gardens as <br />set forth in the Agenda is as follows: <br />Logan Gardens, LLC (709 N. Main Street, P.O. Box 160, Aynor, SC <br />29511) is requesting a reservation of capacity for the Villas at <br />Logan Gardens senior independent living facility, which consists <br />of 44 multi-family units on +/- 4.127 acres located off Booker <br />Drive SW in the City of Concord, North Carolina. <br />School Capacity Review <br />The Villas at Logan Gardens could produce approximately 7 <br />elementary students, 2 middle school students and 3 high schools <br />students for a total of 12 students. The schools impacted by the <br />project are W. M. Irvin Elementary School, J. M. Fries Middle <br />School and Jay M. Robinson High School. This project is planned <br />as a senior independent living facility and could be eligible for <br />an exception to the APFO if the necessary requirements are met. <br />If, however, these units were built for the general population, <br />the students generated would be calculated as indicated above. <br />Note: The calculations below include 20th day enrollment figures <br />from October 20, 2009. <br />
