December 7, 2009 (Work Session) Page 1706 <br />package and advised the County is currently looking at purchasing new <br />software with on-line features. <br />In response to questions from the Board, Ms. Dubois confirmed the <br />action of this item is for reallocation of funds so an architect can be <br />selected. Mike Downs, Deputy County Manager, advised the RFQ (Request for <br />Qualifications) process has already been completed, submitted and awaiting <br />approval. He advised the cost of the project is unknown at this time; <br />however, it is usually based on a percentage of the job. He noted, in the <br />past, architects usually worked on an hourly basis until a permanent contract <br />was secured. He advised approval of this request will get the architects <br />engaged. <br />UPON MOTION of Commissioner Poole, seconded by Vice Chairman Mynatt and <br />unanimously carried, the Board voted to place Concord Library Renovations - <br />Architect Design ($50,000.00) on the December 21, 2009 Agenda as a Consent <br />item. <br />Commerce - Morehead Road Memorandum of Understandin <br />Jonathan Marshall, Commerce Director, announced Chris Kouri, General <br />Counsel for Lowe's Motor Speedway, is present. He reported the Memorandum of <br />Understanding (MOU) is between (CMS) Charlotte Motor Speedway, LLC and the <br />NCDOT (North Carolina Department of Transportation) for the relocation of a <br />segment of Morehead Road. He briefly presented information on the project <br />including the County's and the City of Concord's responsibility in providing <br />requests for the abandonment of road maintenance and right-of-way. He <br />advised the request was brought before the County to make sure the Board is <br />in agreement with the actions that will take place once the new road segment <br />is constructed. <br />In response to questions from the Board, Richard Koch, County Attorney, <br />advised he has reviewed the information and no issues were found. He stated <br />there is a provision in the General Statutes that provides a mechanism for <br />citizens to request the Board to authorize certain improvements to roads. In <br />addition, he said this MOU takes care of the issue in terms of the County <br />making the request and amounts to a release of the whole process. <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Mynatt <br />and unanimously carried, the Board voted to place the Morehead Road <br />Memorandum of Understanding on the December 21, 2009 Agenda as a Consent <br />item. <br />Commerce - Prouosed Rockv River Greenwav at Harris Road Middle School <br />Jonathan Marshall, Commerce Director, announced Mark Kincaid, Deputy <br />Director for the City of Concord Parks and Recreation, and John Wood from <br />HadenStanziale are present. He presented information on the City of <br />Concord's greenway project located between Harris Road and Highway 73. He <br />advised the request is to address the segments of the greenway that crosses <br />the County's property. <br />Mr. Kincaid announced Bob Dallas, Concord Parks and Recreation <br />Director, is also present. He provided the following information: the <br />organization intends to apply for a Parks and Recreation Trust Fund grant on <br />February 1, 2009; upon successful completion and award of the grant, the City <br />plans to take ownership of 44 acres of Moss Creek and develop a one-and-a- <br />half mile trail that would run behind Moss Creek along the Rocky River and <br />onto Harris Road Middle School property; two public workshops have been <br />conducted and a third workshop is scheduled later this week; the City has <br />advertised extensively to inform residents of the project; and the consultant <br />is available to briefly review the master plan and answer any questions. <br />Commissioner Poole questioned whether the greenway is the one that <br />crosses the school's property and was the greenline previously approved. She <br />also questioned if there was a previous agreement for a boardwalk to be built <br />on that property. In response to questions from the Board, Mr. Kincaid <br />advised there is a trail easement that currently represents that trail; he is <br />not aware of any previous agreements regarding a boardwalk; and there is an <br />existing gravel trail which the City plans to develop and build boardwalks or <br />asphalt trails if the request is approved. <br />Mr. Marshall reported the following information: there is not a <br />segment of the trail following the length of Harris Road; the existing trail <br />was developed by Moss Creek private developers; the trail crosses through an <br />area where both the School Board and Board of Commissioners have agreed to a <br />
