December 21, 2009 (Regular Meeting) <br />(G) NEW BUSINESS <br />Page 1749 <br />(G-1) EDC - Economic Development Grant Rec7uest for SBM Solar, Inc. and <br />Public Hearing - 6:30 P.M. <br />This item was removed from the Agenda at the request of the EDC/SBM <br />Solar, Inc. <br />(G-2) Commerce Department - Proposed Text Amendment - TEXT2009-00012-Chapter <br />8-Conditional Uses and Public Hearing - 6:30 P.M. <br />Jonathan Marshall, Commerce Director, presented a text amendment to <br />Chapter 8 of the Zoning Ordinance for the Conditional Use Standards for <br />Slaughter House/Meat Packing. The request is to modify the current setback <br />requirements from 250 feet to 150 feet for consistency with other <br />agricultural uses in the Ordinance. A public hearing is required. <br />Chairman White opened the public hearing at 6:40 p.m. The Public <br />Hearing Notice was published on December 2, 2009 and December 9, 2009 in THE <br />INDEPENDENT TRIBUNE. The Public Hearing Notice was also posted on the <br />County's website (www.cabarruscounty.us) on December 9, 2009 in accordance <br />with Article 2, Administration, Section 2.1 (Use of Electronic Means to <br />Provide Public Notices) of the Cabarrus County Code of Ordinances. <br />There was no one present to address the Board; therefore, Chairman <br />White closed the public hearing. <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Poole <br />and unanimously carried, the Board adopted the following Ordinance (TEXT2009- <br />00012) amending the Cabarrus County Zoning Ordinance: <br />Ordinance No. 2009-20 <br />AN ORDINANCE AMENDING THE CABARRUS COUNTY ZONING ORDINANCE <br />TEXT2009-00012 <br />BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby <br />amended as follows: <br />Amend Chapter 8, Conditional Uses as follows: <br />DELETE sentence in #26, Slaughterhouse/Meatpacking: No building, <br />structure, storage or animal holding area shall be located within <br />two hundred and fifty (250) feet of any lot line. <br />ADD sentence in #26, Slaughterhouse/Meatpacking: No building, <br />structure, storage or animal holding area shall be located within <br />one hundred and fifty (150) feet of any lot line. <br />Adopted this 21St day of December, 2009 by the Cabarrus County Board of <br />Commissioners. <br />/s/ H. Jay White, Sr., Chairman <br />Cabarrus County Board of Commissioners <br />ATTEST: <br />/s/Kay Honeycutt <br />Kay Honeycutt, Clerk to the Board <br />(G-3) Commerce - Reservation of Capacity Certificate for the Villas at Logan <br />Gardens <br />Jonathan Marshall, Commerce Director, presented the following <br />information regarding a request for a Reservation of Capacity for the Villas <br />at Logan Gardens: a representative of the Villas at Logan Gardens is present <br />to respond to questions from the Board; the project is a senior independent- <br />living facility; as such, school-age children are not allowed to reside at <br />the facility; therefore, an exception to the County's Adequate Public <br />Facilities Ordinance is permissible; and, Richard Koch, County Attorney, has <br />finalized the restrictive conditions of the project. In addition, Mr. <br />Marshall recommended approval of the Reservation of Capacity for the project. <br />The Reservation of Capacity and Capacity Schedule for the Villas at <br />Logan Gardens as set forth in the Agenda is as follows: <br />
