January 22, 2008 (Regular Meeting) <br />Page 684 <br />Canterfield Estates (Canterfield, LLC), a subdivision near Harrisburg, <br />donated approximately 37.76 acres for use as a greenway at Pharr Mill Road <br />Park. The following resolution accepts the property and expresses <br />appreciation to Canterfield LLC. <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Mynatt <br />and unanimously carried, the Board adopted the following resolution: <br />Resolution No. 2008-02 <br />RESOLUTION AUTHORIZING ACCEPTANCE OF <br />CONVEYANCE OF CERTAIN REAL PROPERTY <br />AND EXPRESSING APPRECIATION TO CANTERFIELD, LLC <br />WHEREAS, Canterfield, LLC has developed a residential subdivision named <br />Canterfield Estates near Harrisburg in No. 1 Township; and <br />WHEREAS, Canterfield, LLC has set aside a certain amount of open space in <br />that subdivision where the property abuts Rocky River; and <br />WHEREAS, this real property consists of five tracts totaling approximately <br />37.76 acres; and <br />WHEREAS, this real property is in an area of rapid residential growth and <br />this gift will preserve open space and recreational facilities and allow <br />creation of a greenway upon land that would otherwise be subject to dense <br />development; and <br />WHEREAS, the Board of Commissioners desires to accept the gift of this real <br />property for the purposes expressed in the deed and to express their <br />appreciation to Canterfield, LLC; and <br />WHEREAS, there are no environmental, legal or other issues involving title to <br />or condition of this real property that would cause the County to decline <br />this gift of real property; <br />NOW, THERE FORE, BE IT RESOLVED by the CABARRUS COUNTY BOARD OE COMMISSIONERS <br />as follows: <br />1. That in behalf of Cabarrus County and its citizens, the Board of <br />Commissioners agrees to accept the conveyance of these five tracts of real <br />property adjacent to Rocky River from Centerfield, LLC for the benefit of its <br />citizens; <br />2. The County Manager or his designee and the County Attorney are directed <br />to take all action necessary and execute any documents required to represent <br />and protect the County's interest and/or to transfer title of the Properties <br />to the County; and <br />3. The County acknowledges with much gratitude Centerfield, LLC for its <br />generous donation to the citizens of Cabarrus County. <br />Adopted: This 22ntl day of January, 2008. <br />/s/ H.
