April 21, 2008 (Regular Meeting) <br />Page 796 <br />Elementary School, Northwest Cabarrus Middle School and Northwest <br />Cabarrus High School. <br />Cox Mill High School, which is under construction, is projected <br />to open in 2010 in the western part of Cabarrus County. This <br />school will relieve Northwest Cabarrus and Jay M. Robinson High <br />Schools. <br />The County's Capital Improvements Plan (CIP) includes <br />construction of a new middle school in 2010 in the south central <br />part of the County that would relieve Northwest Cabarrus Middle <br />School, Harris Road Middle School and J.N. Fries Middle School. <br />The CIP also includes a 175-seat addition to Northwest Cabarrus <br />Middle School. <br />The CIP also includes a 200 seat addition at Charles E. School capacity is also inadequate for this subdivision <br />at the five year review level. (Note that according to Section <br />15-11, Number 5 0£ the APFO, future available capacity must be <br />"...greater than or equal to the projected enrollment that will be <br />produced by the proposed development for all school types," not <br />just one or two). <br />Recommendation <br />Based on the direction of the Board of Commissioners, until <br />changes are implemented in the ordinance, staff proposes the <br />following: <br />1. Mitigation of the pro-rata share of the cost of planned <br />capacity, which equals $4,283.00 per residential townhome <br />unit, payable prior to building permitting. <br />Ms. Watts responded to questions from the Board. <br />Vice Chairman Juba MOVED to approve the Consent Agreement between <br />Cabarrus County and David Wightman Homes, Inc. for the Wightman Oaks Townhome <br />Project, including the payment of $9,283.00 per residential townhome unit to <br />advance school adequacy (payable prior to building permitting) with the <br />following build-out schedule: no more than 10 residential townhome permits <br />issued in 2008 and no more than 3 residential townhome permits issued in <br />2009. She further moved to authorize the County Manager to execute the <br />agreement on behalf of Cabarrus County. Commissioner Mynatt seconded the <br />motion. <br />After a brief discussion on school capacity and capital funding, the <br />MOTION carried with Chairman White, Vice Chairman Juba and Commissioner <br />Carruth and Mynatt voting for and Commissioner Privette voting against. <br />(G-2) Reservation of Capacity Certificate - Alexander Estates Subdivision <br />
