April 21, 2008 (Regular Meeting) Page 806 <br />Richard Koch, County Attorney, recommended the Villas at Forest Park <br />Apartment Project be tabled until the May 19, 2008 regular meeting. He <br />reported the applicant is proposing that the project be exempted from the <br />Adequate Public Facilities Ordinance and Voluntary Mitigation Payment for the <br />following reasons: (1) the project will be restricted to persons over the age <br />of 55 and the disabled; and (2) the project will not produce any school <br />students. However, he said the applicant needs more time to provide <br />additional supporting documentation. <br />UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board voted to table the Reservation of Capacity <br />Certificate for the Villas at Forest Park Apartment Project until the May 19, <br />2008 regular meeting. <br />ect - <br />Certificate - <br />Dee Rankin, representative for the Founder's Reserve Subdivision <br />Project, explained that the developer's attorney would not be able to attend <br />tonight's meeting. He also said he spoke to the developer and his attorney <br />and both support County staff's recommendation, including the phasing <br />schedule and voluntary mitigation payment. <br />Recommendation <br />Based on the direction of the Board of Commissioners, until <br />changes are implemented in the ordinance, staff proposes the <br />following: <br />1. Mitigation payment of the pro-rata share of the cost of <br />planned capacity, which equals $6,617.00 per single-family <br />residential lot, payable prior to final platting. <br />Mr. Rankin further reported the donation of a school site is planned in <br />future phases. Commissioner Mynatt commented that the donation of a school <br />site may or may not be a good situation for the school system and expressed <br />concern about including the donation in the agreement. <br />Mr. Rankin responded to questions from the Board. <br />Commissioner Carruth MOVED to approve the Reservation of Capacity for <br />the Founder's Reserve Subdivision Project, including Mitigation payment of <br />the pro-rata share of the cost of planned capacity, which equals $8,617.00 <br />per single-family residential lot, payable prior to final platting and the <br />following phasing schedule: no more than 4 single-family residential lots <br />platted in 2008; no more than 5 single-family residential lots platted in <br />2009; no more than 5 single-family residential lots platted in 2010; no more <br />than 5 single-family residential lots platted in 2011; no more than 5 single- <br />family residential lots platted in 2012; and no more than 19 single-family <br />residential lots platted in 2013. He further MOVED to authorize the Cabarrus <br />County Commerce Director to execute the Certificate on behalf of Cabarrus <br />County. Commissioner Mynatt seconded the motion. <br />Commissioner Privette commented on the lack of school capacity <br />available at the five-year level and stated his intent to vote against the <br />motion. <br />For the record, Vice Chairman Juba confirmed that Mr. Dee Rankin has <br />been speaking on behalf of the developer of the Founder's Reserve Subdivision <br />Project and his attorney. <br />
