July 7, 2008 (Work Session) <br />Page 896 <br />John Day, County Manager, announced this is the first time <br />someone has come before the Board after receiving the Reservation of <br />Capacity to the second step which is the Mitigation Agreement. <br />UPON MOTION of Commissioner Mynatt, seconded by Commissioner <br />Carruth and unanimously carried, the Board voted to place the Adequate <br />Pubic Facilities Mitigation Agreement for the Meadow Creek Apartment <br />project on the July 21, 2008 Agenda as a Consent item. <br />Commerce - Consent Agreement - Preston Ridge Apartment Project <br />Susie Morris; Planning and Zoning Manager, presented the <br />following information related to a Consent Agreement for the Preston <br />Ridge Apartment project: <br />The Preston Ridge apartment project was approved by the <br />City of Concord Planning and Zoning Board on November 21, <br />2006. The project consists of 912 multi-family units on +/- <br />49.791 acres located on Weddington Road. The specifics of <br />the agreement are as follows: <br />• Developer - Weddington Road Properties, LLC, P.O. Box <br />1229, Wilmington, NC 28401 <br />• Payment of $1, 331 per unit will be due prior to the <br />issuance of building permits. <br />• Build out schedule would be no more than 292 multi- <br />family residential apartment unit building permits <br />issued in calendar year 2009, no more than 170 multi- <br />family apartment unit building permits issued in <br />calendar year 2010. <br />The APFO worksheet filled out by Mr. Robert Kluttz with <br />Cabarrus County Schools indicates that schools impacted by <br />the Preston Ridge apartment project are currently <br />functioning at the following capacities: <br />Carl A. Furr Elementary School - 98.26 <br />Harris Road Middle School - 119.90 <br />Jay M. Robinson High School - 99.61 <br />Including previously approved subdivisions, these schools <br />will be functioning at the following capacity upon <br />completion of the Preston Ridge apartment project: <br />Carl A. EurrElementary School - 111.56 <br />Harris Road Middle School - 173.988 <br />Jay M. Robinson High School - 110.98 <br />The Capital Improvement Plan includes the Cox Mill High <br />School, projected to open in 2009 and will provide relief <br />to Jay M. Robinson and Northwest Cabarrus High Schools. An <br />addition at Carl A. Furr Elementary School in 2010 will add <br />200 seats. The CIP also includes a new middle school in <br />2010 in the south central part of the county that will <br />provide relief to Harris Road Middle School. All <br />improvements listed above are to be funded in the 2009 <br />fiscal year. <br />Cabarrus County Schools operating at 110 capacity are <br />considered to be operating at the maximum capacity. <br />The Subdivision Lot Inventory has been updated through July <br />of 2008. <br />UPON MOTION of Vice Chairman Juba, seconded by Commissioner <br />Carruth and unanimously carried, the Board voted to place the Consent <br />Agreement for the Preston Ridge Apartment project on the July 21, 2008 <br />Agenda as a New Business item. <br />Commeroe - Consent Agreement Renewal - Buffalo Creek Subdivision <br />Project <br />Susie Morris, Planning and Zoning Manager, presented the <br />following information. related to a Consent Agreement for the Buffalo <br />Creek Subdivision project: <br />
