August 18, 2008 (Regular Meeting) Page 930 <br />HAVA Grant Funds - 2008 Special HAVA Grant Revenue <br />96091510-9854-SPEC $0.00 $7,000.00 $7,000.00 <br />HAVA Grant Funds - 2006 Special HAVA Grant Expense <br />(F-2) Commerce Department - Conservation Easement on the 100-year Floodplain <br />on Clark Creek on the Cox Mill Elementary School Campus <br />The boundary for the requested conservation easement corresponds <br />roughly with the boundary of the state-designated Clarke Creek Heron Rookery <br />Significant Natural Heritage Area (SNHA). The State holds a conservation <br />easement on another portion of this SNHA on property owned by Cabarrus Soil <br />and Water Conservation District (SWCD). The requested conservation easement <br />is on 26.65 acres, exclusive of an access easement. The Cabarrus County <br />Board of Education previously voted in support of this conservation easement. <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board granted a conservation easement to the <br />Cabarrus Soil and Water Conservation District on 26.65 acres inside the 100- <br />year floodplain on the Cox Mill Road Elementary School, subject approval by <br />the County Manager and County Attorney. <br />(F-3) Commerce Department - Easement Request from PSNC Energy <br />PSNC Energy had to make an emergency gas line repair for a line on N.C. <br />73 adjacent to the Cabarrus County property where Concord Middle and Irvin <br />Elementary are located. They are requesting an easement where the line had <br />to be relocated. That easement is 10' in width and the total area is .0814 <br />acre. The request includes an offer of $10.00 in compensation; however, <br />discussions are ongoing to increase the compensation to $2,500.00. In the <br />past, proceeds from property sales on school property have been budgeted to <br />benefit those schools. <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board approved the easement agreement between <br />Cabarrus County and PSNC Energy, including the payment of $2,500.00, and <br />authorized the County Manager to execute the contract on behalf of Cabarrus <br />County, subject to review or revisions by the County Attorney. By the same <br />vote, the Board adopted the following budget amendment: <br />BUDGET REVISION/AMENDMENT REQUEST <br />DEPARTMENT OF COMMERCE <br />AMOUNT: $2,500.00 <br />TYPE OF ADJUSTMENT: Supplemental Request <br />PURPOSE OF REQUEST: Utility easement for PSNC Energy to repair a gas line at <br />Concord Middle and Irvin Elementary on NC 73. Proceeds to be given to <br />Cabarrus County Schools. <br /> Present <br />Account No. Ap proved Budget Increase Decrease Revised Budget <br />00161710-6603 $5,000.00 $2,500.00 $7,500.00 <br />Misc Revenue <br />00197210-9701-0586 $0.00 $2,500.00 $2,500.00 <br />CCS-NC 73 Easement <br />On June 9, 2008, the Cabarrus County Board of Education approved <br />transferring title to the land at the School Bus Garage site to the County to <br />enable the County to receive sales tax refunds on the construction project. <br />Associated with this process is the execution of Agency Lease Agreements <br />between Cabarrus County and the Cabarrus County Board of Education allowing <br />the Cabarrus County Board of Education to lease the property until the <br />construction/financing of the project is completed. <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board approved the title transfer on property <br />held by the Cabarrus County Board of Education to Cabarrus County and <br />directed the County Attorney to work with the Board of Education's attorney <br />to execute the transfer. By the same vote, the Board also approved the <br />related Agency and Lease Agreements, subject to attorney review. <br />0 <br />
