November 17, 2008 (Regular Meeting) Page 1062 <br />Teen Court <br />00191980-9394 $55,678.00 $13,614.00 69,292.00 <br />Teen Court <br />(G-4) Commerce Department - Consent Agreement Extension for the Hawthorne <br />Subdivision <br />Kassie Watts, Senior Planner, presented the following information <br />regarding a Consent Agreement extension for the Hawthorne Subdivision: the <br />Hawthorne subdivision was approved by the Harrisburg Planning and Zoning <br />Board on November 21st, 2006; the subdivision was approved for a one-year <br />extension by the Harrisburg Town Council on November 13t" 2008; the proposed <br />build out schedule has been extended to no more than 29 lots to be platted in <br />2008, no more than 32 lots platted in 2009, no more than 32 lots platted in <br />2010 and no more than 16 lots platted in 2011; and the developer is <br />requesting a one-year extension of the Consent Agreement. Ms. Watts also <br />reported that the developer of the subdivision is present to answer any <br />questions. <br />Commissioner Mynatt MOVED to approve the Consent Agreement between <br />Cabarrus County and Meridian Development, LLC for the Hawthorne Subdivision, <br />including the payment of $6,000.00 per lot to advance school adequacy with <br />payment due at final platting, and to authorize the County Manager to execute <br />the Agreement on behalf of Cabarrus County, subject to review or revisions by <br />the County Attorney. Commissioner Carruth secondedthe motion. <br />Commissioner Privette voiced his intent to vote against the motion, <br />noting school overcrowding. <br />The MOTION carried with Chairman White, Vice Chairman Juba and <br />Commissioners Carruth and Mynatt voting for and Commissioner Privette voting <br />against. <br />_(G-5) Commerce Department - Consent Agreement for The Grand Apartment <br />Project <br />Kassie Watts, Senior Planner, presented the following information <br />regarding a Consent Agreement for The Grand Apartment Project: <br />The Grand Apartments received rezoning and site plan approval by <br />the Kannapolis Planning and Zoning Board on February 7, 2007. <br />This project is approved for 240 multi-family apartment units on <br />+/-18.37 acres and is located on Trinity Church Road. The <br />specifics of the agreement are as follows: <br />• Developer - McClain Barr & Associates, 6353 Poplar Forest <br />Drive, Summerfield, NC 27358. <br />• Payment of $1,331.00 per unit will be due at building <br />permitting. <br />• Proposed build out schedule is no more than 290 building <br />permits issued in 2008. <br />The revised APFO worksheet filled out by Mr. Robert Kluttz with <br />Cabarrus County Schools indicates that schools impacted by The <br />Grand Apartments are currently functioning at the following <br />capacities: <br />Charles E. Boger Elementary School - 81.86 <br />Northwest Cabarrus Middle School - 105.65 <br />Northwest Cabarrus High School - 129.52 <br />Including previously approved subdivisions, these schools will be <br />functioning at the following capacity upon completion of The <br />Grand Apartments project: <br />Charles E. Boger Elementary School - 180.62 <br />Northwest Cabarrus Middle School - 155.18 <br />Northwest Cabarrus High School - 197.69 <br />The Capital Improvement Plan revised in July 2006 includes Cox <br />Mill High School is projected to open in 2009 in the western part <br />of the county,'. a new middle school is proposed in 2010 in the <br />south central ,part of the county, and a 200 seat addition is <br />planned for Charles E.
