November 17, 2008 (Regular Meeting) Page 1065 <br />Commissioner Carruth stated he would like to have Ms. Pless recognized <br />at the next Board of Commissioners' meeting and thank her for her years of <br />service. <br />(I) REPORTS <br />(I-1) Request for Applications for County Boards/Committees <br />Chairman White stated the County has a need for volunteers to serve on <br />the following committees: <br />• Adult Care Home Community Advisory Committee <br />• Animal Preservation and Protection Advisory Committee <br />• Cabarrus Planning and Zoning Commission <br />• Concord Planning and Zoning Commission <br />• Concord Zoning Board of Adjustment <br />• Criminal Justice Partnership Advisory Board <br />• Department of Aging Advisory Board <br />• Home and Community Care Block Grant Advisory Committee <br />• Industrial Facilities and Pollution Control Financing Authority <br />• Juvenile Crime Prevention Council <br />• Nursing Home Community Advisory Committee <br />• Region F Aging Advisory Committee <br />• Watershed Improvement Commission <br />Chairman White urged citizens to go to the County's website to review <br />the list of committees. <br />(J) GENERAL COMMENTS BY BOARD MEMBERS <br />Commissioner Mynatt and Kay Honeycutt, Clerk to the Board, described <br />the concept of Ch3's (Cabarrus Helping Hearts and Hands - the County <br />employees' charitable committee) "Helping Hands" trees is an initiative to <br />provide gifts to the less fortunate and stated the public is welcome to <br />participate. <br />There was discussion related to the Monroe Natural Gas Pipeline and <br />Midland's efforts to condemn property of citizens that do not reside within <br />their jurisdiction; the Board of Commissioners' prior denial of Midlands' <br />request to purchase an easement for the pipeline; and new case law concerning <br />"legal standing". Chairman White requested an update on the new case law at <br />a future meeting. <br />Chairman White announced this is the last publicized meeting for Vice <br />Chairman Juba, commended her for her wisdom and expressed appreciation for <br />her service to the Board and to Cabarrus County. <br />Vice Chairman Juba requested the opportunity to speak at the reception <br />on December 19z. <br />(K) WATER AND SEWER DISTRICT OF CABARRUS COUNTY <br />None. <br />(L) CLOSED SESSION <br />(L-1) Closed Session <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board went into closed sessionto discuss <br />threatened or pending litigation in accordance with N.C.G.S. 143-318(a)(3). <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board moved to come out of closed session. <br />Kellswater Bridge APFO (Adecuate Public Facilities Ordinance) Consent <br />Agreement <br />UPON MOTION of Commissioner Privette, seconded by Vice Chairman Juba <br />and unanimously carried, the Board approved County Attorney's recommendation <br />related to the interpretation of the Kellswater Bridge Adequate Public <br />Facilities Ordinance (APFO) Consent Agreement relating to payment of APFO <br />school adequacy fee as follows: Kellswater is entitled to add contiguous <br />
