SECTION C Statement of purpose of article. <br />It is the purpose of this article to promote the public health, safety and <br />general welfare and to minimize public and private losses due to flood <br />conditions in specific areas by provisions designed to: <br />(1) Restrict and prohibit uses which are dangerous to health, safety and <br />property due to water or erosion hazards, or which result in damaging <br />increases in erosion or in flood heights or velocities; <br />(2) Require that uses vulnerable to floods, including facilities which serve <br />such uses, be protected against flood damage at the time of initial <br />construction; <br />(3) Control the alteration of natural floodplains, stream channels, and <br />natural protective barriers which are involved in the accommodation of <br />floodwaters; <br />(9) Control filling, grading, dredging and other development which may <br />increase erosion or flood damage; and <br />(5) Prevent or regulate the construction of flood barriers which will <br />unnaturally divert floodwaters or which may increase flood hazards to other <br />lands. <br />(Ord, of 2-16-87, art. 1, § C; Ord. of 10-17-99, art. 1, § C) <br />Sec. 38-29. SECTION D Objectives of article. <br />The objectives of this article are to: <br />(1) Protect human life and health; <br />(2) Minimize expenditure of public money for costly flood control projects; <br />(3) Minimize the need for rescue and relief efforts associated with flooding <br />and generally undertaken at the expense of the general public; <br />(4) Minimize prolonged business interruptions; <br />(5) Minimize damage to public facilities and utilities such as water and gas <br />mains, electric, telephone and sewer lines, streets and bridges located in <br />floodplains; <br />(6) Help maintain a stable tax base by providing for the sound use and <br />development of flood prone areas in such a manner as to minimize flood blight <br />areas; and <br />(7) Ensure that potential home buyers are notified that property is in a <br />flood area. <br />(8) To maintain the natural storage capacity of the floodway and non- <br />encroachment area fringe area. <br />(Ord. of 2-16-67, art. 1, § D; Ord. of 10-17-94, art. 1, § D; Ord. No. 1998- <br />10, 6-15-98) <br />Sec. 38-30. ARTICLE 2 Definitions. <br />Unless specifically defined below, words or phrases used in this article <br />shall be interpreted so as to give them the meaning they have in common usage <br />and to give this article its most reasonable application: <br />Accessory structure means structures which are located on the same parcel of <br />property as the principal structure and the use of which is incidental to the <br />use of the principal structure. Garages, carports and storage sheds are <br />common urban accessory structures. Pole barns, hay sheds and the like qualify <br />as accessory structures on farms, and may or may not be located on the same <br />parcel as the farm dwelling or shop building. <br />Addition (to an existing building) means an extension or increase in the <br />floor area or height of a building or structure. Additions to existing <br />buildings shall comply with the requirements for new construction, unless the <br />addition, renovation or reconstruction to any building that was constructed <br />prior to the initial flood insurance study for that area, and the addition, <br />renovation or reconstruction does not equal 50 percent of the present market <br />value of the structure. Where a fire wall is provided between the addition <br />and the existing building, the addition(s) shall be considered a separate <br />building and must comply with the standards for new construction. <br />Appeal means a request for a review of the local administrator's <br />interpretation of any provision of this article. <br />Area of shallow flooding means a designated AO or VO zone on a community's <br />flood insurance rate map (FIRM) with base flood depths from one to three feet <br />where a clearly defined channel does not exist, where the path of flooding is <br />unpredictable and indeterminate, and where velocity flow may be evident. <br />Area of special flood hazard means the land in the floodplain within a <br />community subject to a one percent or greater chance of [a base flood] being <br />equaled or exceeded in any given year. <br />Base flood means the flood having a one percent chance of being equaled or <br />exceeded in any given year. <br />Base Flood Elevation (BFE) means a determination of the water surface <br />elevations of the base flood as published in the Flood Insurance Study. When <br />the BFE has not been provided in a "Special Flood Hazard Area", it may be <br />obtained from engineering studies available from a Federal, State, or other <br />source using FEMA approved engineering methodologies. This elevation, when <br />combined with the "Freeboard", establishes the "Regulatory Flood Protection <br />Elevation". <br />
