He reported the following: the Board adopted <br />new flood plain maps in October of 2008; additional changes to the County's <br />flood plain prevention ordinance were required to be more in keeping with a <br />model ordinance created by the North Carolina Emergency Management Office; <br />etc. Mr. Marshall provided a copy of the proposed ordinance to the Board and <br />reviewed several proposed changes to the ordinance, including numbering <br />systems; definitions; basis for establishing special flood hazard areas which <br />reference new maps; the establishment of flood plain permits for regulated <br />flood elevation; and variance procedures. Mr. Marshall stated that there is <br />no substantial change in how the ordinance will be administered and a public <br />hearing is required. <br />Chairman White opened the public hearing at 6:98 p.m. The Public <br />Hearing Notice was published on December 4 and December 14, 2008 in THE <br />INDEPENDENT TRIBUNE. <br />There was no one present to address the Board; therefore, Chairman <br />White closed the public hearing. <br />UPON MOTION of Commissioner Privette, seconded by Vice Chairman Mynatt, <br />and unanimously carried, the Board adopted the following ordinance amending <br />Chapter 38, Floods, of the Cabarrus County Code of Ordinances as follows: <br />AN ORDINANCE AMENDING THE CABARRUS COUNTY <br />CODE OE ORDINANCES <br />Ord. No. 2008-15 <br />BE IT ORDAINED that the Cabarrus County Code of Ordinances is hereby amended <br />as follows: <br />CHAPTER 38 ARTICLE II. FLOOD DAMAGE PREVENTION ORDINANCE <br />Change ordinance as follows: <br />ARTICLE II. FLOOD DAMAGE PREVENTION* <br />*State law references: Authority to acquire or improve beach erosion control <br />and flood and hurricane protection works, G.S. 153A-438. <br />ARTICLE 1 STATUTORY AUTHORIZATION, FINDINGS OF FACT, PURPOSE AND OBJECTIVES <br />Sec. 36-26. SECTION A Statutory authorization of article. <br />The legislature of the state has in G.S. 153A-121 delegated the <br />responsibility to local governmental units to adopt regulations designed to <br />promote the public health, safety, and general welfare of its citizenry. <br />Therefore, the county commissioners do ordain this article. <br />(Ord. of 2-16-87, art. 1, § A; Ord. of 10-17-99, art. 1, § A) <br />Sec. 38-27. SECTION B Findings of fact. <br />(a) The flood hazard areas of the county are subject to periodic inundation <br />which results in loss of life and property, health and safety hazards, <br />disruption of commerce and governmental services, and extraordinary public <br />expenditures for flood protection and relief, and impairment of the tax base, <br />all of which adversely affect the public health, safety, and general welfare. <br />(b) These flood losses are caused by the cumulative effect of obstructions in <br />floodplains causing increases in flood heights and velocities, and by the <br />occupancy in flood hazard areas by uses vulnerable to floods or hazardous to <br />other lands which are inadequately elevated, flood-proofed, or otherwise <br />unprotected from flood damages. <br />
