March 12, 2007 (Work Session) Page 289 <br />Commissioner White requested additional information on the history of <br />the project. <br />John Day, County Manager, reported staff will prepare a history of what <br />has been done on the project, locate projects maps, and provide a thorough <br />list of options for the Board at its April Work Session. <br />Sheriff's Department - Increase Faes Collected by the Sheriff's Office for <br />Captain Phil Patterson, Cabarrus County Sheriff's Department, reviewed <br />N.C. General Statute Section 7A-311 which sets the fees for civil processes <br />served within the State. He pointed out the Board of Commissioners sets the <br />fees for out-of-state processes and that surrounding counties charge $50 for <br />them, with the exception of Gaston and Union counties. He also commented on <br />the difficulties and amount of time associated with serving out-of-state <br />processes. In closing, he asked that a resolution be placed on the Agenda <br />setting the out-of-state civil process fee at $50.00 and reported this <br />revenue goes to the General Fund. <br />UPON MOTION of Commissioner Mynatt, seconded by Commissioner White and <br />unanimously carried, the Board agreed to place the resolution on the March <br />26, 2007 Agenda as a Consent item. <br />Midland Volunteer Fire & Rescue (VFR) Inc - Request for Interest-Free Loan <br />for Fire Station <br />Steve Langer, Assistant Fire Marshal, reported Midland VFR, Inc., is <br />requesting theCounty's financial assistance for the construction a new fire <br />station. He said in 2005, the State conducted a 9S Inspection with seven of <br />the County's 13 volunteer fire departments failing the inspection for having <br />service areas more than five miles from their fire station. Due to <br />technological advancements in fire service, he said the State now allows fire <br />stations to have 6-mile service districts and all the fire district maps have <br />been redrawn to reflect the increased service areas. He said Senate Bill 368 <br />allows Cabarrus County to change its fire district boundaries for four of the <br />seven affected districts. However, he said Midland VFR now has service areas <br />beyond the 6-mile perimeter, these areas are unprotected, and will result in <br />increased insurance ratings for the affected homeowners. <br />At the request of Chairman Carruth, Mr. Langer explained how the ISO <br />rating works. Utilizing color coded maps, he identified the areas of the <br />Midland service district that will be unprotected or considered a "Class 10". <br />Chief Allen Burnette of the Midland VFR reported on the amount of <br />increase an average homeowner could expect to pay in insurance premiums in <br />the Class 9 and 10 areas. Mr. Langer and Chief Burnette responded to a <br />variety of questions .from the Board, with the Chief providing general <br />statistics on the unprotected areas. Mr. Langer also reported areas <br />currently unprotected would become protected upon the completion of a new <br />fire station. Chief Burnette presented a preliminary site plan for a new <br />fire station on Highway 29/27 which included individualized sleeping quarters. <br />for emergency personnel, three drive-through bays, etc. <br />There was a general discussion on the location of the unprotected area, <br />number of structures, utilizing the old Bethel school for a fire station, <br />including an EMS station at the new fire station, etc. <br />Chief Burnette '..reported Midland VFR has incurred approximately <br />$117,000.00 in expenses for the following items: purchase of land, surveys, <br />Phase I Environmental. and civil engineering drawings. He estimated <br />finishing the fire station would require an additional $970,000.00. The <br />breakdown is as follows: $789,000.00 for the building, $103,000.00 for curb <br />and guttering, $56,000.00 for paving, $17,000.00 for a retaining wall and <br />$9,000.00 for landscaping. He said the McGee Brothers have agreed to do the <br />masonry work on the fire station at no charge and that negotiations for <br />donated materials with local rock quarries are ongoing and looked favorable. <br />He said anything over $970,000.00 would be paid by the Department's capital <br />reserve fund. He requested a $900,000.00 15-year interest-free loan from the <br />County with the following monthly repayment schedule: years 1 through 5 - <br />$3,000.00; and years 6 through 15 - $6,000.00. He also proposed the loan <br />agreement include a 5-year recall provision. <br />There was general discussion concerning terms of the loan; construction <br />timeframes; tax incentives and protection for surrounding industrial areas. <br />
