Koch, County Attorney, reviewed his memorandum dated May 21, <br />2007, to the Cabarrus. County Board of Commissioners that outlined the Board's <br />options for handling consent agreements for school adequacy. <br />Chairman Carruth reported the Board received reports on the consent <br />agreements for the Roycroft and Saddlebrook subdivisions at the April work <br />session. He commented on the amount of time and money developers have spent <br />in preparing the plans for approval by the Midland Planning Town Council and <br />the Cabarrus County Planning and Zoning Commission. <br />Jonathan Marshall, Commerce Director, responded to several questions <br />from the Board concerning further extension of the proposed build-out <br />schedule. <br />Commissioner Privette commented on the capacity of Bethel Elementary <br />School and C.C. Griffin Middle School. He advocated that the consent <br />agreements should not be approved until there are adequate school seats <br />available. <br />Commissioner Mynatt pointed out the land for the middle school has been <br />purchased and construction of the facility is a high priority. <br />Vice Chairman Juba commented on the approval of consent agreements in <br />the past if they met the requirements and thanked Mr. Koch for preparing the <br />memorandum. She MOVED to approve the Consent Agreement between Cabarrus <br />County and TDW Holdings, LLC for the Roycroft Subdivision, including the <br />payment of $9,034.00 per lot to advance school adequacy due at final platting <br />and the following build-out schedule of no more than 99 lots to be platted in <br />2008; no more than 99lots to be platted in 2009; no more than 99 lots to be <br />platted in 2010; and no more than 64 lots to be platted in 2011. Further, <br />Vice Chairman Juba authorizedthe County Manager to execute the Agreement on <br />behalf of Cabarrus County. <br />Commissioner White seconded the motion. <br />Commissioner Privette stated his intent to vote against the motion and <br />commented on the number of lots approved by the Board of Commissioners in the <br />past. <br />Chairman Carruth pointed out the Planning Boards approve the lots and <br />that Cabarrus Countyhad the foresight to begin asking developers for a <br />contribution to help defray the cost of school construction three years ago. <br />Commissioner Privette further commented on how "the buck stops here", <br />with the Cabarrus County Board of Commissioners. <br />After further discussion, the MOTION carried with Chairman Carruth, <br />Vice Chairman Juba and Commissioners Mynatt and White voting for and <br />Commissioner Privette voting against. <br />(E-4) Consent Agreement - Saddlebrook Subdivision <br />
