June 4, 2007 (Work Session) Page 395 <br />UPON MOTION of Vice Chairman Juba, seconded by Commissioner White and <br />unanimously carried, the Board voted to place the Consent Agreement for The <br />Mills at Rocky River subdivision project on the June 18, 2007 Agenda as a New <br />Business item. <br />Consent Agreement - Meridian Subdivision <br />Jonathan Marshall, Commerce Director, reported the consent agreement <br />for the Meridian subdivision expired in October of 2006 and included the <br />Adequate Public Facilities (APF) amount of $1,008. He further reported a new <br />' consent agreement is needed because the lots are ready to be transferred and <br />permitted; the developer has agreed to pay immediately through the consent <br />agreement; and the new consent agreement includes the current APF amount of <br />$9,039 per lot due to the lapse in time. <br />UPON MOTION of Commissioner Mynatt, seconded by Commissioner White and <br />unanimously carried, the Board voted to place the Consent Agreement for <br />Meridian Subdivision on the June 18, 2007 Agenda as a New Business item. <br />Consent Agreement - Mountain Hrook Phase 6 <br />Jonathan Marshall, Commerce Director, reported Mountain Brook Phase 6 <br />project consists of eight single family residential units which will generate <br />approximately five children. He stated only the elementary school will <br />exceed 110 percent capacity and there are no provisions for a new school to <br />lower capacity. <br />UPON MOTION of Commissioner White, seconded by Vice Chairman Juba and <br />unanimously carried, the Board voted to place the Consent Agreement for <br />Mountain Brook Phase 6 on the June 18, 2007 Agenda as a New Business item. <br />Text Amendment C2007-04-ZT Amendment to Chapter 13, Section 13-12 Zone Change <br />Filing Procedures <br />Susie Zakraisek, Planning and Zoning Manager, reported Text Amendment <br />No. C2007-09-ZT amendment to Chapter 13, Section 13-12 Zone Change Filing <br />Procedures addresses the concerns of the Board of Commissioners regarding <br />' rezoning cases that involve 50 or more parcels of land. She said the <br />proposed amendment would require an additional letter to be sent to all <br />impacted property owners, including adjacent property owners. <br />UPON MOTION of Commissioner Mynatt, seconded by Commissioner Privette <br />and unanimously carried, the Board voted to place Text Amendment No. C2007- <br />09-ZT amendment to chapter 13, Section 13-12 Zone Change Filing Procedures on <br />the June 18, 2007 Agenda as a New Business item and scheduled a public <br />hearing. <br />Text Amendment C2007-05-ZT Appendix A, Typical Street Standards <br />Susie Zakraisek, Planning and Zoning Manager, reported Text Amendment <br />No. C2007-O5-ZT Appendix A, Typical Street Standards addresses the standards <br />for streets and roads in the unincorporated areas of Concord that are not <br />covered by NCDOT. She further reported NCDOT, the City of Concord and <br />Cabarrus County have met for over four months working on a plan to include <br />street and road maintenance by NCDOT in the unincorporated areas. She <br />further reported streets that are not designed to NCDOT and Concord's <br />standards will not be accepted for maintenance. She also stated a road <br />paving schedule will be included. <br />John Day, County Manager, asked if the changes had to do with width. <br />Ms. Zakraisek reported the changes have to do w'.th landscaping, tree <br />placement, sidewalks and areas behind the sidewalks, general clean up, etc. <br />' She also commented that the previous typicals were based on Traditional & <br />Neighborhood Development Standards. <br />Mr. Day commented on the correlation between driven speed and the <br />width of a street and also on the correlation between placement of trees and <br />the safety of people on sidewalks. He said the standards that were adopted <br />addressed those issues and tried to moderate speed through width which <br />oftentimes cities and the DOT are often reluctant to do. <br />Ms. Zakraisek also commented on text changes to address fire codes. <br />Finally, she reported NCDOT and the City of Concord reviewed and approved the <br />updates. <br />
