June 18, 2007 (Regular Meeting) Page 410 <br />UPON MOTION of Commissioner Privette, seconded by Commissioner White <br />and unanimously carried, the Board approved the Service Agreement between <br />Cabarrus County and Cabarrus County Schools for the North Carolina Special <br />Olympics and authorized the County Manager and County Attorney to execute the <br />agreement on behalf of the County. <br />(F-6) Land Donated by Canterfield Homeowners' Association for Pharr Mill <br />Road Park <br />Upon the request of the Cabarrus County Parks and Recreation Dept., ' <br />Canterfield Homeowners Association agreed to donate a small strip of land <br />(0.199 acre) to Cabarrus County. This land will be utilized for crossing and <br />connecting Pharr Mill Road Park's utilities, sidewalks, emergency park <br />entrance and buffer fencing. The following resolution authorizes the <br />acceptance and conveyance of certain real property to Cabarrus County. <br />UPON MOTION of Commissioner Privette, seconded by Commissioner White <br />and unanimously carried, the Board adopted the following resolution: <br />Resolution No. 2007-12 <br />A RESOLUTION AUTHORIZING ACCEPTANCE OF <br />CONVEYANCE OF CERTAIN REAL PROPERTY <br />WHEREAS, the Cabarrus County Board of Commissioners (the "Board") <br />hereby determines that it is necessary, beneficial and in the public interest <br />to accept the conveyance of certain real property which is owned by those <br />persons or entities identified in the Exhibit A attached (the "Properties") <br />for the purpose of adding to the inventory of parkland and open space in the <br />County. <br />WHEREAS, the persons identified in Exhibit A are willing to donate the <br />Properties to the County without payment therefore. <br />WHEREAS, these persons have represented to the County that there are no <br />environmental, legal or other issues involving the title to or condition of <br />the Properties which would cause a reasonably prudent grantee to decline <br />ownership of the Properties. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CABARRUS COUNTY BOARD OF <br />COMMISSIONERS that: <br />1. The Cabarrus County Board of Commissioners agrees to accept <br />conveyance to the County of the Properties for the benefit of its <br />citizens. <br />2. The County Manager or his designee and the County Attorney are <br />directed to take all action necessary and execute any documents <br />required to represent and protect the County's interest and/or to <br />transfer title of the Properties to the County. <br />3. The County acknowledges with much gratitude the persons owning the <br />Properties for their generous donation to the citizens of Cabarrus <br />County. <br />Adopted: This the 18`h day of June, 2007. <br />/s/: Robert W. This space is "sublet" to them as an "in-kind" <br />contribution.
