June 18, 2007 (Regular Meeting) Page 410 UPON MOTION of Commissioner Privette, seconded by Commissioner White and unanimously carried, the Board approved the Service Agreement between Cabarrus County and Cabarrus County Schools for the North Carolina Special Olympics and authorized the County Manager and County Attorney to execute the agreement on behalf of the County. (F-6) Land Donated by Canterfield Homeowners' Association for Pharr Mill Road Park Upon the request of the Cabarrus County Parks and Recreation Dept., ' Canterfield Homeowners Association agreed to donate a small strip of land (0.199 acre) to Cabarrus County. This land will be utilized for crossing and connecting Pharr Mill Road Park's utilities, sidewalks, emergency park entrance and buffer fencing. The following resolution authorizes the acceptance and conveyance of certain real property to Cabarrus County. UPON MOTION of Commissioner Privette, seconded by Commissioner White and unanimously carried, the Board adopted the following resolution: Resolution No. 2007-12 A RESOLUTION AUTHORIZING ACCEPTANCE OF CONVEYANCE OF CERTAIN REAL PROPERTY WHEREAS, the Cabarrus County Board of Commissioners (the "Board") hereby determines that it is necessary, beneficial and in the public interest to accept the conveyance of certain real property which is owned by those persons or entities identified in the Exhibit A attached (the "Properties") for the purpose of adding to the inventory of parkland and open space in the County. WHEREAS, the persons identified in Exhibit A are willing to donate the Properties to the County without payment therefore. WHEREAS, these persons have represented to the County that there are no environmental, legal or other issues involving the title to or condition of the Properties which would cause a reasonably prudent grantee to decline ownership of the Properties. NOW, THEREFORE, BE IT RESOLVED BY THE CABARRUS COUNTY BOARD OF COMMISSIONERS that: 1. The Cabarrus County Board of Commissioners agrees to accept conveyance to the County of the Properties for the benefit of its citizens. 2. The County Manager or his designee and the County Attorney are directed to take all action necessary and execute any documents required to represent and protect the County's interest and/or to transfer title of the Properties to the County. 3.
