<br />(iii) For purposes of this definition, construction of a new source
<br />has commenced if the owner or operator has:
<br />(A) Begun, or caused to begin as part of a continuous on-
<br />site construction program:
<br />(1) Any placement, assembly, or installation of
<br />facilities or equipment; or
<br />(2) Significant site preparation work including
<br />clearing, excavation, or removal of existing
<br />' buildings, structures, or facilities which is
<br />necessary for the replacement, assembly, or
<br />installation of new source facilities or
<br />equipment; or
<br />(B) Entered into a binding contractual obligation for the
<br />purchase of facilities or equipment which are intended
<br />to be used in its operation within a reasonable time.
<br />Options to purchase or contracts which can be
<br />terminated or modified without substantial loss, and
<br />contracts for feasibility, engineering, and design
<br />studies do not constitute a contractual obligation
<br />under this definition.
<br /> (31) Nitrogen (NH3) as ammonia.an The initial product in the
<br /> decomposition of nitrogenous organic matter as measured by using
<br /> standard laboratory methods, as set out in this ordinance,
<br /> expressed in mg/l.
<br /> (32) Non-Contact Cooling Water or Wastewater. Water used for cooling
<br /> which does not come into direct contact with anv raw material,
<br /> intermediate product waste product or finished product.
<br /> (33) Non-discharge Permit.~~ A disposal system permit issued by
<br /> the State pursuant to N.C.G.S. 193-215.1.

<br />from the processes employed in industrial, manufactur
<br /> business establishments, as distinct from domestic wastes.
<br /> (35) NPDES or National Pollutant Discharge Elimination System. shall
<br /> mean A permit issued pursuant to Section 902 of the Act (33 U.S.C.
<br /> 1392) or pursuant to N.C.G.S. 193-215.1 by the State under
<br /> delegation from EPA.
<br />(36) Pasa Through. `~'~ea%T A discharge which exits the POTW into
<br />waters of the State in quantities or concentrations which, alone or
<br />in conjunction with a discharge or discharges from other sources,
<br />causes a violation, including an increase in the magnitude or
<br />duration of a violation, of any requirement and/or limit
<br />established in the POTW's NPDES Permit(s) and/or Non-discharge
<br />Permit(s) and/or of anv standard established in a downstream water
<br />quality standard.
<br />(37) Person.~~ AnY individual, firm, company, partnership, co-
<br />partnership, corporation, association, joint stock company, trust,
<br />estate, governmental entity, limited liability company or
<br />partnership, or any other legal entity, or their legal
<br />representatives, agents or assigns. This definition includes all
<br />Federal, State, and local government entities.
<br />(38) pH. ~mear* A measure of the acidity or alkalinity of a
<br />substance, expressed as standard units, and calculated as the
<br />logarithm (base 10) of the reciprocal of the concentration of
<br />hydrogen ions expressed in grams per liter of solution. A pH value
<br />of 7.0 is neutral, above 7.0 is alkaline and below 7.0 is acid.
<br />(39) Pollutant.~.a~~~^~ Any "waste" as defined in N.C.G.S. 193-213
<br />(13) and dredged spoil, solid waste, incinerator residue, sewage,
<br />garbage, sewage sludge, munitions, medical wastes, chemical
<br />wastes, biological materials, radioactive ma~=erials, heat, wrecked
<br />or discarded equipment, rock, sand, cellar dirt and industrial,
