An upset does not include noncompliance to the <br />extent caused by operational error, improperly designed <br />pretreatment facilities, inadequate pretreatment facilities, lack <br />of preventive maintenance, or careless or improper operation. <br />(63) Uaer. shal~caeer: Any person who contributes, causes or ' <br />permits the contribution of wastewater into the POTW •,..~ <br />.,s.,...,.,, or proposes such a contribution, including persons <br />who contribute such wastes from mobile sources. <br />(69) Wastewater. °'°'^-~,ea,~ The liquid and water-carried, industrial <br />and/or domestic wastes, from dwellings, commercial buildings, <br />industrial facilities, mobile sources, treatment facilities, <br />and/or institutions together with any groundwater, surface water, <br />and/or storm water that may be present, whether treated or <br />untreated, which are contributed into or permitted to enter the <br />POTW. <br />
