In addition the Executive Director is authorized to <br />designate one or more classes of users and may establish one or <br />more limited conditions for inclusion in all wastewater dischar e <br />permits issued to users in a designated class <br />shall be allowed at least 30 da s within which to submit written <br />comments to the Executive Director. Thereafter, the Executive <br />Director may make such condition or class effective without <br />modification or may modify such condition or class without further <br />notice to any person <br />(3) For each condition established ursuant to this subsection, the <br />Executive Director shall determine the effective date thereof. From <br />and after the effective date of each condition established ursuant <br />to this subsection, ever wastewater dischar e ermit which is <br />issued, renewed, amended, or otherwise modified shall contain: <br />every general condition which remains in effect• -nd for each user <br />in one or more classes desi Hated ursuant to this subsection, <br />every applicable limited condition. <br />(2) In designating a class the Executive Director shall identify one <br />or more common factors characterizin the members of such class and <br />determine that at least five (5) ermitted users satisf all of <br />such factors. Before a condition established or class desi Hated <br />up rsuant to this subsection may take effect written notice of such <br />condition Or class shall be given to all users holding a permit at <br />the time that such condition or class is ro osed and such users <br />Adjudicatorv Hearin <br />(1) Persons entitled to hearing The following persons are entitled to <br />a hearing pursuant to this section• <br />(a) an applicant for a wastewater dischar e permit or other <br />~rmit required by this ordinance who is denied a permit or <br />is granted a permit subject to conditions which are <br />unacceptable to the applicant• <br />(b) a user who is assessed a civil enalt ursuant to Section <br />B.2; <br />(2) <br />(c) a user to whom an order is issued ursuant to Section 8.1 (d) <br />or (e) . <br />Demand for hearing. <br />(a) Any person entitled to a hearing pursuant to this section <br />shall exercise such ri ht as set forth in Section <br />4.3(f)(2)(b). Such demand shall be in writin and state <br />separately each issue to be considered and such other matters <br />as are hereinafter required <br />(b) AnV person making a demand for a hearing shall deliver the <br />demand to the Executive Director within the followin <br />a licable time limits after receipt of notice of the action <br />to be heard: <br />(i) 30 days for the denial of a permit required by this <br />ordinance or for the grant of a permit required by this <br />grdinance subject to conditions which are unacceptable <br />to the applicant• <br />(ii) 30 days of the assessment of a civil penalty <br />(iii) 20 days for a compliance order issued pursuant to <br />Section 8.1(d); <br />(iv) 10 days for a cease and desist order issued pursuant to <br />Section 8.1(e). <br /> <br /> <br />u <br />(3) Contents of demand.
