June 18, 2007 (Regular Meeting) Page 956 (J) misrepresentations or failure to fully disclose all relevant facts in the wastewater dischar e ermit application or in any required reporting; (K) revision or a grant of variance from categorical pretreatment standards pursuant to 40 CFR 403 13 (L) tc correct typographical or other errors in the wastewater discharge permit• or (M) to reflect a transfer of the facilit ownershi ' or operation to a new owner or operator (2) Within nine (9) months of the promulgation of a National categorical pretreatment standard, the wastewater discharge permit of users subject to such standards shall be revised to require compliance .with such standard within the time frame prescribed by such standard. Where a user, subject to a National categorical pretreatment standard, has not previously submitted an application for a wastewater discharge permit or does not currently have an SIU ermit, as required by section 9.2 (b), the user shall apply ~a ^-g~a,,,=~ within 180 days after the promulgation of -' - -- --- such standard. (3) A request for a modification by the Permittee shall constitute a waiver of the 60 day notice required by N.C.G.S. 193-215.1 (b) for modifications. (c) Permit Transfer (1) Wastewater discharge permits are issued to a specific user for a specific operation. A Permittee may not assi n transfer or sell a permit, or any right or obligation in a permit, to another user or person. A-waste~ra6e~ rte; `ta~~e-pc~m4t sha3~--ne-t pe (2) Wastewat di er scharge permits may be transferred t o a new owner or o erator only if the Permittee requests of WSACC a transfer at least sixty (60) days inadvance of the proposed transfer and WSACC a roves the wastewater discharge permit transfer Within five (5) business days of the date of facility transfer authorized representatives of the Permittee and the new owner or operator must give ioint, written notice to WSACC of the date of transfer If the transfer has been approved WSACC shall take such steps as are necessary to document the transfer of the permit The request to WSACC to transfer the permit must include a written certification in a form satisfactory to the Executive Director by the new owner or operator which: (A) States that without rior notification to and a royal b WSACC, the new owner and/or operator agrees not to make any cktange or expansion in the manufacturin /production and/or ~rei.reatment process used by the Permittee which has potential to impact the characteristics or volume of the discharge or the manner in which the discharge is regulated (B) Identifies the specific date on which the proposed transfer is to occur; and (C ) Acknowledges and accepts full resp onsibility for , cOmPlying with all terms and provisions of the wastewater discharge permit to be transferred Failure t o comply fully with the provisions of this ordinance renders the wastewater discharge permit void as of the date of facilit y transfer (d) Permit Reissuance A SIU shall apply for permit reissuance by submitting a complete permit application in accordance with Section 9.2 a minimum of 180 days prior to the expiration of the existing permit.
