Further, the Board authorized the County <br />Manager to execute the Agreement on behalf of Cabarrus County. <br />(G-9) Park Land Donated by Mra. Mary Lore Flows Brown (W.W. Flows Trust) <br />Steve Little, Parks & Recreation Director, asked the Board to adopt a <br />resolution accepting the conveyance of real property. <br />Sam Davis, Attorney with Hartsell & Williams, P.A., representing the <br />estate of Mrs. Mary Lore Flows Brown commented on the generosity of the W. W. <br />Flows and Mary Lore Flows Brown. <br />UPON MOTION of Vice Chairman Juba, seconded by Commissioner Mynatt with <br />Chairman Carruth, Vice Chairman Juba, and Commissioner Mynatt voting for and <br />Commissioner White abstaining, the Board adopted the following resolution: <br />Resolution No. 2007-17 <br />RESOLUTION AUTHORIZING ACCEPTANCE OF <br />CONVEYANCE OF CERTAIN REAL PROPERTY <br />AND EXPRESSING APPRECIATION TO MARY LORE FLOWE BROWN <br />WHEREAS, in 1995 Mary Lore Flows Brown and husband, Harry G. Brown gave to <br />Cabarrus County and its people approximately 65 acres of land adjoining and <br />near Central Cabarrus High School, which land has now become the W.W. Flows <br />Park; and <br />WHEREAS, Mary Lore Flows Brown passed away on March 14, 2007 and in her will <br />gave additional real property to Cabarrus County and its citizens for use as <br />a public park and recreation facility; and <br />WHEREAS, this real property consists of 60.308 acres across Central Heights <br />Drive from W.W. Flows Park, but near to the Park and to Central Cabarrus High <br />School; and <br />WHEREAS, this real property is in an area of rapid residential growth and <br />this gift will preserve open space and recreational facilities upon land that <br />would otherwise be subject to dense development; and <br />WHEREAS, the Board of Commissioners desires to accept the gift of this real <br />property for the purposes expressed in the deed and to express their <br />appreciation to the family of Mrs. Brown; and <br />WHEREAS, there are noenvironmental, legal or other issues involving title to <br />or condition of this real property that would cause the County to decline <br />this gift of real property; <br />NOW, THEREFORE, BE IT RESOLVED, by the CABARRUS COUNTY BOARD OF <br />COMMISSIONERS, as follows: <br />1. That in behalf of Cabarrus County and its citizens, the Board of <br />Commissioners agrees to accept the conveyance of this 60.308 acre tract <br />of real property adjacent to Central Heights Drive from the Estate of <br />Mary Lore Flows Brown for the benefit of its citizens; <br />2. The County Manager or his designee and the County Attorney are directed <br />to take all action necessary and execute any documents required to <br />represent the County's interest and/or to transfer title of this real <br />property to the County; and <br />3. The County acknowledges with much gratitude Mrs. Mary Lore Flows Brown <br />for her generousdonation to the citizens of Cabarrus County. <br />Adopted: This 23`d day of July, 2007. <br />BY: /s/ Robert W.
