<br />The Board of Commissioners for the County of Cabarrus met in recessed
<br />session for a joint meeting with the Kannapolis City Council at the
<br />Kannapolis Train Station, 201 South Main Street in Kannapolis, North
<br />Carolina, on Monday, September 29, 2007, at 7:30 p.m.
<br />Present - Chairman: Robert W. Carruth
<br />Vice Chairman: Joni D. Juba
<br />Commissioners: Grace Mynatt
<br />Coy C. Privette
<br />H. Jay White, Sr.
<br />Also present were John D. Day, County Manager; Richard M. Koch, County
<br />Attorney; and Kay Honeycutt, Clerk to the Board.
<br />Also in attendance were Robert Misenheimer, Mayor; Randy Cauthen, Mayor
<br />Pro-Tem; Council members: Richard Anderson, Kenneth Leathers, Roger Haas,
<br />Darrell Hinnant and Gene McCombs; Mike Legq, City Manager; Brent Jeffcoat,
<br />Bond Counsel; and Bridqette Bell, City Clerk.
<br />Call to Order
<br />Chairman Carruth called the meeting to order at 7:30 p.m.
<br />Closed Session - To Diacusa Matters Relating to the Location or Expansion of
<br />industries or Other Businesses Served by the Public Body as Authorized by
<br />UPON MOTION of Vice Chairman Juba, seconded by Commissioner White and
<br />unanimously carried, the Board moved to go into Closed Session.
<br />UPON MOTION of Commissioner Mynatt, seconded by Commissioner Privette
<br />and unanimously carried, the Board moved to come out of Closed Session.
<br />Recess of Meeting
<br />To accommodate a large number of citizens in attendance for the joint
<br />meeting scheduled for 8:00 p.m., the meeting was briefly recessed in order to
<br />relocate from the Conference Room to the Council chambers.

<br />Chairman Carruth reconvened the meeting at 7:52 p.m.

<br />s on the NCRC
<br />Chairman Carruth thanked the Kannapolis City Council for agreeing to
<br />meet with the County Commissioners to finalize the NCRC TIF project list.
<br />Mayor Misenheimer, stated the Kannapolis City Council was extremely
<br />anxious to get the project list finalized and turned the meeting over to City
<br />Manager Mike Legg.
<br />Mr. Legg reviewed a color-coded TIF project list totaling
<br />$206,052,176.00 that categorized the individual projects into the following
<br />categories: A - $18,679,797.00 - completed or contracted for; B -
<br />$84,313,170.00 - must have critical projects; C - $62,661,696.00 - important
<br />but not critical; and D - $90,377,603.00 - desired but potential deferral.
<br />The County's $45,200,000.00 projects were identified as follows: C -
<br />(important but not critical) - $31,000,000.00 and D - (desired but potential
<br />deferral) - $19,200,000.00. Note: the A.L. Brown High School Science Wing -
<br />$10,300,000.00, the Fishertown Water and Sewer Project - $5,700,000.00 and
<br />the Cabarrus Health Alliance - $15,000,000.00 were in Category C; and the Cox
<br />Mill High School Science Wing - $5,000,000.00, a library - $3,000,000.00 and
<br />a senior center - 6,200,000.00 were in Category D. Mr. Legq reported there
<br />are approximately $139,000,200.00 of available TIF project funds; "A" and "B"
<br />projects total $102,992,927.00, which leaves approximately $31,007,273.00 for
<br />"C" projects. Next, he reviewed the County's projects for eligibility. He
<br />reported the A.L. Brown science wing is eligible and meets the rational nexus
<br />test; the Fishertown utility project is eligible but determining the rational
<br />nexus is challenging; and the Health Alliance is eligible and has the best
<br />rational nexus. The other county projects were identified as either not
<br />meeting the statutory requirements or the rational nexus test.
<br />Mayor Misenheimer opened the floor for discussion. There was a lengthy
