December 3, 2007 (Work Session) Page 642 <br />UPON MOTION of Commissioner White, seconded by Commissioner Privette <br />and unanimously carried, the Board voted to place the Consent Agreements for <br />the following projects on the December 17, 2007 Agenda as New Business items: <br />Crescent Apartments at Kannapolis Multi-Family Apartment project and Rocky <br />Glen Subdivision. <br />Change Order No.l (Phase 2I) - Corban Avenue Road Widening <br />Mike Downs, Deputy County Manager, presented Change Order No. 1 <br />totaling $100,377.05 for the installation of turn lanes and driveway cuts on <br />Corban Avenue for the Law Enforcement Complex. He reported the road <br />improvements are required by the City of Concord and the North Carolina <br />Department of Transportation (NCDOT). He further reported the expense was <br />anticipated and budgeted outside of Turner Construction's contract. <br />Mr. Downs responded to minor questions from the Board. <br />UPON MOTION of Commissioner Mynatt, seconded by Commissioner White and <br />unanimously carried, the Board voted to place Change Order No. 1 (Phase II) - <br />Corban Avenue Road Widening on the December 17, 2007 Agenda as a Consent <br />item. <br />Courthouse Study - Update <br />John Day, County Manager, announced a Courthouse Master Plan meetingis <br />scheduled for Monday, December 17, 2007 at 8:00 a.m. in the Multipurpose Room <br />at the Governmental Center. <br />Speedway Area Improvements - Update <br />John Day, County Manager, presented a preliminary estimate totaling $97 <br />million for improvements around Lowe's Motor Speedway and said there are more <br />projects than available funding. He announced a meeting is tentatively <br />scheduled on Thursday, December 6, 2007 between Speedway Motorsports, Inc. <br />(SMI) employees, Department of Transportation representatives, the Concord <br />City Manager and himself to begin the process of prioritizing and narrowing <br />the projects. <br />Mr. Day responded to several questions from the Board about the <br />estimate and a brief discussion ensued. <br />ewer Authority of Cabarrus County (WSACC) - <br />Richard M. Koch, County Attorney, reported on the leasing and transfer <br />of sewer interceptors and outfall lines to WSACC in accordance with a 1991 <br />settlement agreement between Cabarrus County and the City of Concord. He <br />said WSACC took over the sewer lines but the deeds were not transferred nor <br />has any lease agreements been signed. He said Concord has already <br />transferred its share of the lines to WSACC and the non-warranty deeds have <br />been prepared for the County to transfer its interest to WSACC. <br />Commissioner White MOVED to recuse himself. He stated his employer, <br />the law firm of Hartsell & Williams, PA, prepared the deeds. Vice Chairman <br />Juba seconded the motion. The MOTION unanimously carried. <br />Mr. Koch stated he had reviewed the maps and the deeds. <br />UPON MOTION of Vice Chairman Juba, seconded by Commissioner Privette, <br />with Chairman Carruth, Vice Chairman Juba and Commissioners Mynatt and <br />Privette voting for and Commissioner White abstaining, the Board voted to <br />place WSACC - Transfer of Non-Warranty Deeds on the December 17, 2007 Agenda <br />as a New Business item. <br />Granting of Right-of-Way and Easement - Bethel United Methodist Church <br />John Day, County Manager, reported a right-of-way easement is needed <br />for Bethel United Methodist Church to connect to a forced main sanitary sewer <br />line on county-owned property at the Bethel Elementary School. He said the <br />property was originally purchased with COPS (Certificates of Participation); <br />therefore approval from the Board of Commissioners is required. He also <br />reported the Cabarrus County Board of Education approved the sale of the <br />right-of-way and the $5,000.00 will be transferred to the Bethel Elementary <br />School for its use. <br />
