<br />March 13, 2006 - Agenda Work Session <br /> <br />Page <br /> <br />528 <br /> <br />Lease Agreement for Additional Space for the Department of Social Services <br /> <br />Mike Downs, Deputy County Manager, reported the proposed lease between <br />Cabarrus County and Kannapolis Land, Inc., for 2,800 square feet of office <br />space at the Department of Social Services (DSS) contains an additional fee <br />to cover the estimated expenses for the common areas, property taxes and <br />insurance. This fee totals $132.98 per month and will be adjusted annually. <br />The base rent is still $6.00 per square foot. <br /> <br />Mr. Downs responded to questions about repaving the DSS parking lot. <br /> <br />UPON MOTION of Vice Chairman Juba, seconded by Chairman Carruth and <br />unanimously carried, the Board voted to place the Lease Agreement between <br />Cabarrus County and Kannapolis Land, Inc., on the March 20, 2006 Agenda as a <br />Consent item. <br /> <br />Distribution of Agenda <br /> <br />Mr. <br />week due <br />timeframe <br /> <br />Day reported the March Agenda would be distributed later <br />to his attendance at an out-of-town meeting and the <br />between the Agenda Work Session and the Regular Meeting. <br /> <br />in the <br />reduced <br /> <br />Public Comment Policy <br /> <br />Chairman Carruth reported he would present a revised Public Comment <br />Policy entitled, uTownhall Cabarrus" at Monday night's meeting. He asked if <br />anyone was present who wished to address the Board. There was no one; <br />however, Chairman Carruth stated he would wait 10 minutes after the meeting <br />adjourned before leaving. <br /> <br />Announcement of Settlement of Litigation <br /> <br />Chairman Carruth read the following Announcement: <br /> <br />Announcement of Settlement of Litigation <br /> <br />Cabarrus County has settled the case Donald Kaufman v Cabarrus <br />County Tax Assessor, 03 CVS 2679 (Cabarrus County Superior <br />Court) . This case involved a wrongful discharge claim by a <br />former employee of the County Tax Assessor's office. The County <br />did then and does now deny liability of this claim, believing <br />this discharge was for legitimate reasons, but on advice of <br />counsel settled this matter for payment of $30,000.00 to <br />plaintiff plus payment of certain of the plaintiff's costs not to <br />exceed $12,000.00. Approval of the terms of the settlement was <br />made by the Commissioners in closed session as permitted by the <br />Open Meetings Law. The case has been dismissed and the matter is <br />concluded. <br /> <br />Cabarrus County has also settled the case of Rebekah Efird v <br />Sheriff of Cabarrus County, 1: 04 CV 397 (United States District <br />Court of MONC). This case involved a number of claims, some of <br />which were dismissed by the District Court. A Title VII claim <br />and a claim for negligent supervision survived the County's <br />motion to dismiss. The County then and does now deny liability <br />for these claims, but on advice of counsel and during court <br />ordered mediation, settled this matter for a payment of <br />$25,000.00 to plaintiff. Approval of the terms of the settlement <br />was made by the Commissioners in closed session as permitted by <br />the Open Meetings Law. The case has been dismissed and the <br />matter is concluded. <br /> <br />Announcement of these settlements is made pursuant to the Open <br />Meetings Law (NCGS ~ 143-318.11) <br /> <br />Adjournment <br /> <br />With there being no further business to come before the Board, Chairman <br />Carruth adjourned the meeting at 6:53 p.m. <br /> <br />j-t1~ J-.~ <br /> <br />Clerk to the Board <br />
