<br />June 191 2006 - Regular Meeting <br /> <br />Page <br /> <br />638 <br /> <br />the definitions of these words in reference to a Code of Ethics and said it <br />is time for the Board to create a Code of Ethics. <br /> <br />Colin Nowlin of Davidson Road stated he is opposed to the proposed <br />rezoning appeal fees. In most cases, he said the average citizen does not <br />have funds to appeal rezoning decisions and the fees should already be <br />incorporated into the property taxes. He said if citizens appeal a <br />particular rezoning petition, it is most likely because the application is <br />not conducive to the community and/or orderly planning. He said the proposed <br />fee for an appeal is an attempt to suppress citizens who are concerned about <br />reckless growth and development occurring in the community. <br /> <br />Fred Wally of Mooresville Road commented on the proposed fee for <br />appeals of rezoning petitions. He reported no fee is charged now and it <br />should be a fundamental right for any citizen to appeal a rezoning decision <br />on a no-fee basis. He said unlike a developer, a citizen who files a <br />rezoning appeal stands to make no profit from the action. If a fee is <br />necessary, he said the cost should be built into the fee charged the <br />developer when he/she applies for the rezoning. He further reported a <br />rezoning appeal fee is not charged in Iredell, Mecklenburg, Stanly, and Rowan <br />counties. Mr. Wally also asked for an update on the following: (1) Chairman <br />Carruth's and Commissioner Freeman's meeting with Kannapolis officials <br />concerning the annexation of a four-acre parcel on the western side of Coddle <br />Creek Reservoir; and (2) what action the Board plans to take in reference to <br />his letter of June 10, 2006, outlining the requested action by residents of <br />the Odell community. <br /> <br />Betty Lipe of Odell School Road presented a proposed resolution <br />entitled, "Resolution Calling for a Moratorium on the Annexation of All <br />Municipalities within Cabarrus County into the Proposed City of Odell". She <br />asked the Board to support the Odell community in this issue. <br /> <br />Commissioner Privette asked if the Resolution could be added to the <br />Agenda for this meeting. <br /> <br />Chairman Carruth stated he and Commissioner Freeman had not had an <br />opportunity to meet with Mayor Misenheimer concerning this matter. However, <br />he had spoken with Mayor Misenheimer about the possibility of a committee of <br />Kannapolis and Odell representatives. Chairman Carruth suggested the <br />Resolution be placed on the July Agenda to allow time for a meeting to be <br />scheduled with the Mayor and to give the County Attorney time to review the <br />Resolution. <br /> <br />Richard Koch, Acting County Attorney, reported the Resolution has some <br />language issues in it. He said the Board has no legal authority over <br />annexations by municipalities. <br /> <br />UPON MOTION of Commissioner Carpenter, seconded by Commissioner <br />Privette and unanimously carried, the Board voted to place the \\Resolution <br />Calling for a Moratorium on the Annexation of All Municipalities within <br />Cabarrus County into the Proposed City of Odell" on the July 10, 2006 Agenda <br />with the Attorney to address the language of the proposed Resolution. <br /> <br />Jerry Williamson of Marsh Avenue in Concord stated the County has <br />trouble balancing the budget in spite of numerous tax increases. He asked if <br />any County departments ever return unspent funds, if anything is ever cut <br />from the budget and if the Board ever thinks about the taxpayers. He also <br />asked if anything had been done regarding the immigration issues and proposed <br />that Board members be elected on a two-year basis. He also suggested the <br />County could save money by having the County Attorney watch videotapes of <br />County meetings from home or his office instead of attending lengthy <br />meetings. He said the Board was elected to keep the property taxes low and <br />had not done so. <br /> <br />With there being no one else to address the Board, Chairman Carruth <br />closed that portion of the meeting at 7:21 p.m. <br /> <br />(E) OLD BUSINESS <br /> <br />(E-l) Cabarrus County Property Tax Assistance Grant <br /> <br />John Day, County Manager, reported 21 citizens participated in the <br />Cabarrus County Property Tax Assistance Grant program that was established in <br />2005. Grants for the 2005 tax year totaled $5,069.00. He asked Brent <br />Weisner, the Tax Administrator, to explain the program further. <br />
