<br />June 19, 2006 - Regular Meeting <br /> <br />Page <br /> <br />661 <br /> <br />PURPOSE OF REQUEST: Due to the high number of children served in Child <br />Protective Services and Foster Care, the cost of Medical Consultants has <br />exceeded the budgeted amount. Reimbursement <br />$138,000.00 $153,000.00 <br /> <br />Decrease <br /> <br />Revised Budget <br />$3,039,301.00 <br /> <br />$291,000.00 <br /> <br />(F-34) Contract for the 2006-2007 HOME Program <br /> <br />The HOME Program is a scattered site housing rehabilitation program <br />that is administered through the Cabarrus/Iredell/Rowan HOME Consortium. <br />Cabarrus County has participated in the program for the past 11 years. A 25 <br />percent match is required for the program and is in the proposed FY 2006-2007 <br />County budget. Cabarrus County has already held the mandatory public <br />hearings for the grant. <br /> <br />UPON <br />Carpenter <br />Consortium <br />authorized <br /> <br />MOTION of Commissioner Privette, seconded by <br />and unanimously carried, the Board approved the <br />Program contract contingent upon attorney and budget <br />the County Manager to execute the contract. <br /> <br />Commissioner <br />2006-07 HOME <br />approval, and <br /> <br />(F-35) Lease and Agency Agreement between Cabarrus County and Cabarrus <br />County Board of Education nunc pro tunc as of July 1, 2005 for the C.A. Furr <br />Elementary, Charles E. Boger Elementary and Hickory Ridge High Schools <br /> <br />Effective July 1, 2005, School systems can no longer claim sales tax <br />refunds on their purchases or for construction proj ects. In order for the <br />County to take advantage of the sales tax savings, it is proposed that <br />Cabarrus County Schools transfer the Furr, Boger and Hickory Ridge property <br />to the County with a lease and agency agreement between the County and the <br />Schools. The Schools will be considering a Resolution at its meeting on June <br />22 to approve the Lease, Agency Agreement and transfer of property to the <br />County nunc pro tunc as of July 1, 2005. <br /> <br />UPON MOTION of Commissioner Privette, seconded by Commissioner <br />Carpenter and unanimously carried, the Board approved the Lease Agreement and <br />Agency Agreement between Cabarrus County and the Cabarrus County Board of <br />Education nunc pro tunc as of July 1, 2005 for the C. A. Furr Elementary, <br />Charles E. Boger Elementary and Hickory Ridge High Schools and authorized the <br />Chairman to execute the documents on behalf of Cabarrus County, subject to <br />approval of the Board of Education at its meeting on June 22, 2006. <br /> <br />ITEMS REMOVED FROM THE CONSENT AGENDA FOR DISCUSSION <br /> <br />(F-33) Fourth Amendment to Purchase and Sale Agreement with Allen Craven, <br />LLC for the Purchase of the Fo~er Cabarrus Bank/First Union Building <br /> <br />Upon completion of an upset bid process for the sale of the former <br />Cabarrus Bank/First Union Building in August 2005, the Board entered into a <br />Purchase and Sale Agreement with Allen Craven, LLC on August 15, 2005. In <br />order for Mr. Craven to complete his work necessary to conclude the <br />transaction, a Fourth Amendment to the Purchase and Sale Agreement has been <br />requested. This Amendment would extend the Due Diligence Date 420 days and <br />the Closing Date 450 days from the Effective Date of the Agreement. <br /> <br />Commissioner Carpenter asked to be recused from voting due to her <br />employment with Wachovia Bank (formerly First Union) . <br /> <br />UPON MOTION of Commissioner Freeman, seconded by Chairman Carruth and <br />unanimously carried, the Board recused Commissioner Carpenter from voting on <br />the Fourth Amendment to the Purchase and Sale Agreement. <br /> <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Freeman <br />with Chairman Carruth, Vice Chairman Juba and Commissioners Freeman and <br />Privette voting for and Commissioner Carpenter abstaining, the Board approved <br />the Fourth Amendment to the Purchase and Sale Agreement by and between <br />Cabarrus County and Allen Craven, LLC, and authorized the County Manager to <br />execute the Amendment, subject to review by the County Attorney. <br />
