<br />July 10, 2006 (Regular Meeting) <br /> <br />Page <br /> <br />5 <br /> <br />with there being no one else to address the Board, Chairman Carruth <br />closed that portion of the meeting at 7:17 p.m. <br /> <br />(B) OLD BUSINESS <br /> <br />(B-1) Request for a Resolution Calling for a Moratorium on Annexation by All <br />Municipalities within Cabarrus County into the Proposed City of Odell <br /> <br />Chairman Carruth reported that Betty Lipe presented a proposed <br />resolution to the Board on June 19 calling for a moratorium on annexations <br />into the proposed City of Odell. He said there had been brief discussion at <br />that meeting about the County's authority or lack thereof concerning <br />annexations and the Board had agreed to place the issue on the Agenda for the <br />July meeting. <br /> <br />Chairman Carruth asked Richard M. Koch, the Acting County Attorney, to <br />comment on the resolution that had been submitted by Ms. Lipe. <br /> <br />Mr. Koch reported <br />annexations. He said the <br />Lipe seemed to imply that <br />annexation policies. <br /> <br />the County has no authority over municipal <br />language in the proposed resolution drafted by Ms. <br />the County does have some authority over municipal <br /> <br />Chairman Carruth stated he and Commissioner Freeman met recently with <br />Kannapolis Mayor Bob Misenheimer and Mayor Pro-Tem Randy Cauthen to discuss <br />the annexation issue. He said the Kannapolis officials would support a <br />meeting between several Council members and representatives from the Odell <br />Community. Chairman Carruth also commented on the Board's prior approval of a <br />resolution supporting the rights of the Odell citizens to seek incorporation, <br />the County's lack of authority over municipal annexations, a property owner's <br />right to seek the highest and best use of his/her land and the lack of impact <br />that the annexation would have on the operation of Lake Howell. <br /> <br />Chairman Carruth proposed that a committee, consisting of <br />representatives from the Odell community and the Kannapolis City Council, be <br />established for the following purpose: (1) to identify gaps between the <br />County's zoning and development standards and the Kannapolis development <br />standards and zoning districts; (2) to identify key issues created when <br />Kannapolis annexes a property; and (3) to discuss areas of potential <br />cooperation between the Odell community and the City of Kannapolis. Also, he <br />discussed the possibility of hiring a consultant to facilitate future <br />committee meetings at the County's expense if the committee feels it would be <br />beneficial. <br /> <br />Chairman Carruth made a motion to form the committee as proposed for <br />representative of the Kannapolis City Council and Odell Community. Vice <br />Chairman Juba seconded the motion. <br /> <br />Commissioner Privette stated the Board should, in addition to forming <br />the committee, adopt a resolution asking municipalities not to annex property <br />in the Odell community until the incorporation process is complete. He <br />offered an amendment to Chairman Carruth's motion to include the adoption of <br />the resolution presented by Betty Lipe at the June 19th meeting. <br /> <br />There was further discussion on adopting a resolution without legal <br />merit and allowing the committee to meet at least once before taking action. <br /> <br />Commissioner Privette's amendment died for lack of a second. <br /> <br />After further discussion, Chairman Carruth amended his original motion <br />to include a provision that the committee is to meet by August 1, 2006. <br /> <br />vice Chairman Juba accepted Chairman Carruth's amendment and the motion <br />unanimously carried. <br /> <br />Betty Lipe reported the <br />second phase and will be heard <br />begins in January, 2007. <br />annexations on the Kannapolis <br />for the Odell community. <br /> <br />Odell incorporation application is in the <br />in the General Assembly's long session, which <br />She also reported there are several other <br />agenda and stated August 1 would be too late <br /> <br />UPON MOTION of Commissioner Carpenter, seconded by Commissioner <br />Privette and unanimously carried, the Board agreed for Chairman Carruth to <br />send a letter to the Kannapolis City Council asking the City Council, as a <br />courtesy, to table consideration of any other voluntary annexations until the <br />committee has an opportunity to meet. <br />
