<br />July 10, 2006 (Regular Meeting) <br /> <br />Page <br /> <br />6 <br /> <br />Chairman Carruth briefly responded to earlier comments regarding a <br />quote in the newspaper concerning the annexation by the City of Kannapolis. <br />He said he had been referring to the annexation of Lake Howell and the fact <br />the annexation would have no impact on the operation of the lake. However I <br />he said he recognized that it is a \lbig issue" when talking about a person's <br />community. <br /> <br />(E-2) Establishment <br />Military Personnel Who <br />(B-3) Cabarrus County <br /> <br />of a Committee to Plan a Celebration <br />Have Served in Iraq and Afghanistan <br />Property Tax Assistance Grant <br /> <br />in <br /> <br />Honor <br /> <br />of <br /> <br />Items E-2 & E-3 were removed from the Agenda. <br /> <br />(B-4) Consent Agreement - Oxford Commons Subdivision <br /> <br />Kassie G. Watts, Planner, presented a Consent Agreement for the Oxford <br />Commons Townhome subdivision. This item had been tabled by the Board at its <br />meeting on June 19. She reported the subdivision, to be developed by <br />Portrait Homes, was approved by the Concord Planning and Zoning Board on <br />April 18, 2006 and consists of 260 townhome residential units on 34.7 acres <br />located on pitts School Road. The Consent Agreement included a payment of <br />$1,331.00 per lot due at final platting to advance school adequacy. Ms. Watts <br />said the developer has submitted a revised build out schedule as follows: 40 <br />lots platted in 2006, 80 lots platted in 2007, 80 lots platted in 2008 and 60 <br />lots platted in 2009. Including previously approved subdivisions, these <br />schools will be functioning at the following capacity upon completion of the <br />Oxford Commons Subdivision and before completion of new schools: Cox Mill <br />Elementary School 159.66 percent; Harris Road Middle School 124.65 <br />percent; and Jay M. Robinson High School - 126.00 percent. <br /> <br />Chairman Carruth <br />municipalities and are <br />school adequacy. He <br />options. <br /> <br />stated the majority of developments are approved by <br />then brought to the County to address the issue of <br />asked the County Attorney to explain the Board's <br /> <br />Richard M. Koch, Acting County Attorney, outlined the following two <br />approval options: (1) Approve with a phased build out schedule; or (2) <br />Approve but delay permitting until there is sufficient school adequacy in <br />that area. <br /> <br />There was a brief discussion on school capacity, when school capacity <br />will be adequate and the advancement of school adequacy by the developer. <br /> <br />Commissioner Privette made a motion to approve the Consent Agreement <br />for the Oxford Commons Subdivision with the development to wait until school <br />capacity is adequate before residences can be constructed. <br /> <br />commissioner Freeman seconded the motion. <br /> <br />There was further discussion on school adequacy and the relief the new <br />Hickory Ridge High School and Carl Furr Elementary School, which are <br />projected to open in 2007, will provide to Jay M. Robinson High School and <br />Cox Mill Elementary School. Also, Mr. Koch pointed out the importance of <br />handling all developments and school adequacy issues in a consistent manner <br />in accordance with County policy. <br /> <br />Commissioner Privette's motion failed with Commissioners Freeman and <br />Privette voting for and Chairman Carruth, Vice Chairman Juba and Commissioner <br />Carpenter voting against. <br /> <br />Frank Strazulla, a representative of Portrait Homes, responded to <br />questions concerning the square footage of the units and commented on the <br />average family size of townhome owners. Due to an engineering disapproval, <br />he reported the company would have difficultly constructing 40 units in 2006. <br /> <br />Jonathan Marshall, Commerce Director, reported townhome projects <br />generate fewer students than single family developments. Therefore, he <br />stated the adequacy contribution is $1,331.00 per unit. <br /> <br />Vice Chairman Juba made a motion to approve the Consent Agreement <br />between Cabarrus County and Portrait Homes for the Oxford Commons Townhome <br />Subdivision, including the payment of $1,331. 00 per lot to advance school <br />adequacy and a build out schedule of 40 lots platted in 2006, 80 lots platted <br />in 2007, 80 lots platted in 2008 and 60 lots platted in 2009. <br /> <br />Commissioner Carpenter seconded the motion. <br />
