August 14, 2006 (Agenda Work Session) Page 36 Informal Public Comments Chairman Carruth opened the meeting for Informal Public Comments at 5:07 p.m. Fred Wally of Mooresville Road asked to have the rules of procedure for the public comment portion of the Wayne Brothers Rezoning hearing in advance of the meeting. He reported the rules of procedure worked well at the Planning and Zoning Commission meeting and commented on the length of time allotted to the planning staff, the petitioner, the opposition and the rebuttal period. He said if the Board chooses to allow rebuttal period, a separate time frame of 10 - 20 minutes for each side is requested. He also commented on the receipt of a letter from Mayor Misenheimer that stated the Kannapolis City Council would not be participating in a proposed public meeting concerning voluntary annexations, but would accept and respond to wri tten questions submitted by the Odell community. Mr. Wally expressed disappointment with the decision and reported there are three resolutions on the Kannapolis August agenda for voluntary annexation. The resolutions were identified as follows: Pelham Point subdivision (61.03 acres), Niblock Development Corporation (162.527 acres), and Triune Development LLC (108.247 acres) . He said there are 331 acres that will be voluntarily annexed by Kannapolis and all of them are located on Jim Johnson Road. He said these annexations defeat the purpose of the Odell community which is to set land aside an area that could be developed in a wise manner. Mr. Wally reiterated his disappointment with the Kannapolis decision and asked the Board for an update on the situation. Chairman Carruth stated he still wants to get individuals together to talk about this issue, has other ideas and that he spoke to Mayor Misenheimer about this issue earlier this morning. Mr. Wally stated the citizens of Odell are still willing to meet with Kannapolis officials. Betty Lipe of Odell School Road stated the Board will be meeting with Kannapolis officials later this evening and that Kannapolis will want financial assistance with the North Carolina Research Campus which gives the County a little leverage. Ms. Lipe stated she does not mind if Kannapolis runs water and sanitary sewer lines into the Odell community, but does not want to be annexed. Wi th there being no one else to address the Board, Chairman Carruth closed that portion of the meeting at 5:14 p.m. Recess The Board took a short dinner break at 5:14 p.m. Chairman Carruth reconvened the meeting at 5:25 p.m. Immigration Study Committee Chairman Carruth suggested the Board establish the composition and the purpose of the Immigration Study Committee tonight. Vice Chairman Juba suggested the Chairman and Vice Chairman develop a list of areas to be included in the study, (i.e., medical, educational, business representation etc.) and names of possible committee members. She said the Chairman and Vice Chairman would contact the individuals and make a formal presentation to the Board. There was a brief discussion on several other possible scenarios for establishing the committee's membership.
