<br />August 21, 2006 (Regular Meeting) <br /> <br />Page 60 <br /> <br />Section 14. The Chairman or Vice-Chairman of the Board, the Clerk to <br />the Board, the County Manager, the Finance Officer and the other officers of <br />the County are each hereby authorized and directed to execute and deliver for <br />and on behalf of the County any and all certificates, documents and other <br />papers, including, without limitation, Letter(s) of Representations to <br />Securities Depositories and agreements relating to investment of proceeds of <br />the Bonds (including repurchase agreements), and to perform any and all acts <br />they may deem necessary or appropriate in order to carry out the intent of <br />this resolution and the matters herein authorized. <br /> <br />Section 15. <br /> <br />This resolution shall take effect upon its passage. <br /> <br />Upon motion of Commissioner Carpenter, seconded by <br />the foregoing resolution entitled: "RESOLUTION PROVIDING <br />$48,000,000 PUBLIC IMPROVEMENT BONDS, SERIES 2006" <br />following vote: <br />Ayes: Commissioners Carpenter and Freeman; Vice <br />Chairman Carruth. <br />Noes: None. <br /> <br />Vice Chairman Juba, <br />FOR THE ISSUANCE OF <br />was passed by the <br /> <br />Chairman <br /> <br />Juba <br /> <br />and <br /> <br />(F-6) GovDeals, Inc. - Electronic Auction Services Agreement <br /> <br />An agreement with GovDeals, Inc., will permit the County to dispose of <br />surplus equipment via electronic auction services. On-line (electronic) <br />auctions may be conducted under the rules for auctions found in N. C. G. S. <br />160A-270(c), if they are for property valued at less than $30,000.00 and the <br />board has delegated authority for disposal to the manager under N. C. G. S. <br />160A-266 (c) . The referenced delegated authority was granted to the County <br />Manager on December 19, 1004. <br /> <br />UPON MOTION of Commissioner Carpenter, seconded by Vice Chairman Juba <br />and unanimously carried, the Board approved the contract between GovDeals, <br />Inc., and Cabarrus County for electronic auction of County surplus property <br />and authorized the County Manager to execute the agreement. <br /> <br />(F-7) Revised Cabarrus County Contract Administration Policy <br /> <br />The Contract Administration Policy has been updated and revised through <br />a joint effort of the Purchasing Agent/Contract Administrator and the County <br />Attorney to ensure that all contractual and legal issues are addressed. <br />Updates and revisions are proposed for the Contract Administration Policy. <br />Modifications include the addition of (iv) reimbursable expenses, the update <br />of section (v) signature authority of dollar limits which were adjusted due <br />to recent legislation, and the addition of memorandum of <br />understanding/agreements related to grant applications. <br /> <br />UPON MOTION of Commissioner Carpenter, seconded by Vice Chairman Juba <br />and unanimously carried, the Board adopted the Cabarrus County Contract <br />Administration Policy as set forth below and authorized the County Manager to <br />make subsequent revisions as necessary. <br /> <br />CABARRUS COUNTY CONTRACT ADMINISTRATION POLICY <br />(THE "POLICY") <br /> <br />PURPOSE AND OVERVIEW: <br /> <br />This Policy is intended for internal use of the County <br />intended to infer benefits to nor is it to be relied <br />contracting with the County. Such parties are encouraged to <br />their own legal counsel. <br /> <br />only and is not <br />upon by parties <br />seek advice from <br /> <br />Due to the rapid growth and increasing complexity of County operations, it is <br />important to establish a Policy that: (1) organizes and catalogs all <br />obligations and rights involving the County; and (2) insures that all <br />federal, state and local laws, rules, regulations and ordinances with regard <br />to County contractual obligations and rights have been met. The purpose of <br />this Policy is to establish the criteria for documenting all County <br />obligations, liabilities and rights with regard to other parties and to <br />create and maintain an efficient and uniform process in the administration of <br />these responsibilities. This Policy will ensure that such matters are <br />handled in a manner that is consistent with excellence in the stewardship of <br />County funds. Adherence to this Policy will also ensure that County <br />purchasing and other applicable policies are complied with and will help <br />ensure that the County obtains the most proficient and cost efficient product <br />
