<br />I <br /> <br />I <br /> <br />I <br /> <br />September 5, 2006 (Recessed Meeting) <br /> <br />Page 77 <br /> <br />The Board of Commissioners for the County of Cabarrus met in recessed <br />session in the Commissioners' Meeting Room at the Cabarrus County <br />Governmental Center in Concord, North Carolina on Tuesday, September 5, 2006, <br />at 6:00 p.m. <br /> <br />Present - Chairman: Robert W. Carruth <br />Vice Chairman: Joni D. Juba <br />Commissioners: Carolyn B. Carpenter <br />Robert M. Freeman <br />Coy C. Privette <br /> <br />Also present were John D. Day, County Manager; Richard M. Koch, <br />Attorney; Frankie F. Bonds, Clerk to the Board; and Kay Honeycutt, <br />Clerk to the Board. <br /> <br />County <br />Deputy <br /> <br />Chairman Carruth called the meeting to order at 6:02 p.m. <br /> <br />Chairman Carruth gave the invocation. <br /> <br />Commissioner Carpenter extended condolences to the family of Durwood <br /> <br />Boss. <br /> <br />Peti tion C2006-06 (R-CD) Peti tioner Wayne Brothers Inc. (Kei th Wayne). <br />Request to Rezone Approximately 76 acres from 0/1 (Office Institutional and <br />A/O (Agriculture/Open Space) to GC-CD (General Commercial Conditional <br />District) and MDR-CD (Medium Density Residential-Conditional District). <br />Portions of PIN's 4673-66-0905, 4673-56-6269, 4673-56-4277 and 4673-47-9022. <br />The purpose of request is for the relocation and expansion of the corporate <br />headquarters and operations center for Wayne Brothers Incorporated. <br /> <br />Chairman Carruth asked those that plan to speak for or against the <br />rezoning application to be specific in their statements and to stay on topic. <br />He reviewed the following Rules of Procedure that were adopted on August 21, <br />2006: <br /> <br />RULES OF PROCEDURE FOR WAYNE BROTHERS CONDITIONAL DISTRICT APPLICATION <br />CABARRUS COUNTY BOARD OF COMMISSIONERS <br />SEPTEMBER 5, 2006 <br /> <br />1. <br /> <br />The Cabarrus <br />staff report <br />time limit on <br /> <br />County planning staff person (s) shall <br />and answer questions from the Board. <br />this presentation. <br /> <br />first present the <br />There will be no <br /> <br />2. After the proponents finish, the opponents (those speaking against the <br />application) will have a total of 45 minutes to speak and/or present <br />documents in support of their position. The 45 minute time limit does <br />not include questions directed to the opponents by the Board. <br /> <br />4. Each side will then have 10 minutes for rebuttal, with the <br />applicant/proponents going first. Again, questions directed to each <br />speaker will not count against the time limit. This will conclude the <br />public hearing portion of the meeting and the Board will proceed to <br />deliberation. <br /> <br />5. Each side is strongly encouraged to use a spokesperson to present the <br />positions commonly held by each. Each side is also strongly encouraged <br />to organize their speakers and presentations to ensure that all persons <br />wanting to speak will have time to do so. <br /> <br />If a speaker has questions of a person on the other side, such <br />questions shall be addressed to the Board members to be redirected to <br />the person to be asked. There will be no direct questioning of one <br />speaker by another except through the Board. <br /> <br />6. <br /> <br />7. Public demonstrations of support for a speaker's comments should be <br />limited to clapping.
